Happy the Elephant
Are elephants human?
Not in the state of New York.
The Nonhuman Rights Project sued the Bronx Zoo, seeking a writ of habeus corpus compelling the zoo to release Happy the Elephant declared legally a “person” and released from “imprisonment” in the zoo.
The New York appeals court ruled that Happy, being a pachyderm, is not legally a person. Only “persons” have the right to invoke the writ of habeus corpus. Corporations, bodies of water, and other animals in countries around the world have been recognized as “persons.” But the U.S. does not recognize nonhuman animals as “persons” with the right to liberty.
For now, Happy will remain in the Bronx Zoo.
