Sometimes buyers want to 'assign' their interest in an offer to purchase to another buyer. There is a lot to talk about around assignments, but for today here's an important fact...
In Alberta, all purchase contracts are assignable. It doesn't matter if the seller doesn't want the contract is signed or even if the contract says it cannot be assigned.
Why? Our Land Titles Act says in s. 154 (1): "Any contract in writing for the sale and purchase of any land, mortgage or encumbrance is assignable notwithstanding anything to the contrary contained in it..."
That's the black letter law. More next time on some of the subtleties and issues.
