As summer draws to a close and most of you have returned from your travels, it is great to see so many people out and about. With school in full swing for most families and Labor Day weekend signaling the official end of the season, our days in the pool and long evenings outside will be coming to an end in the next month or so.
Significant changes recently took effect on August 17th, as the National Association of Realtors implemented new practices aimed at enhancing transparency within the home buying and selling process. These changes are designed to foster greater clarity for both buyers and sellers.
I’ve noticed some confusion and misinformation surrounding these updates. Below, I’ve outlined the key points to ensure you are well-informed.
For Sellers
- Sellers retain full discretion to offer compensation to buyers’ brokers, as they always have. The recent settlement does not restrict this ability.
- While MLS listings will no longer include mentions of buyer broker compensation, such compensation can still be advertised, offered, and negotiated outside of the MLS.
- Sellers can negotiate with buyers regarding the payment of the buyer’s broker’s compensation, should it be requested as part of a purchase offer.
- A seller’s decision on whether to offer compensation may influence how desirable their home is to potential buyers.
For Buyers

Buyers must now sign a written Buyer Representation and Broker Compensation Agreement before touring a home, whether in person or virtually.
- This agreement formalizes the relationship between the buyer and their agent/broker, detailing the duration, compensation, and other terms. It’s important to note that compensation is, and has always been, negotiable.
- Buyers may negotiate with sellers to cover their broker’s compensation, but should be prepared to assume this cost if the seller declines.
- The importance of having exclusive, professional representation cannot be overstated. Realtors are ethically and fiduciarily bound to act in your best interest.
Choosing the right real estate professional is more important now than ever. Look for expertise, integrity, a proven track record, and in-depth knowledge of the local market. An excellent Realtor should be providing invaluable service, serves as a trusted advisor, and maximizes your financial outcome.
