Vague Return-to-Work Date Dooms ADA Claim


The U.S. EEOC’s guidance provides that an extended leave of absence (LOA) beyond the employer’s policy may be a reasonable accommodation under the Americans with Disabilities Act (ADA). The guidance also explains that an indefinite LOA, “will constitute an undue hardship, and so does not have to be provided as a reasonable accommodation.” But what about a request for an LOA with a vague deadline such as, "[I] probably [will] be released in September or October"?

Does the PWFA Discriminate Against Men?


During an employee’s orientation, she told her new employer that she is pregnant. She then incurred pregnancy-related absences such as nausea, swelling in her feet, aching joints, and doctor’s appointments. The employer had a policy that if an employee incurs more than two absences during the probationary period, the employee will be subject to termination. She quit and sued after her supervisor told her she'd be fired if she incurred one more absence.

Documentation Saves the Day!


It’s HR’s song: document, document, document. And here's why. A former employee claims she was fired because she is a woman. Her employer said it was because after just one year of service “she compared unfavorably to peers in the company’s annual employee assessment process.” The employee lost twice, including on appeal to the U.S. 7th U.S. Circuit Court of Appeals.

Happy 35th Anniversary ADA! Why One Employer May Not Have Been Celebrating


July 26th marked the 35th anniversary of the enactment of the Americans with Disabilities Act (ADA). Just two weeks prior, the 8th U.S. Circuit Court of Appeals affirmed a lower court’s finding that an employer violated the ADA when it refused to hire a truck driver who was deaf. The jury initially awarded the plaintiff $36M!

Equal Opportunity Discrimination?


There is a line of case law referred to as equal opportunity harassment cases. The defense is that no unlawful harassment occurs when the offensive conduct is not based on any individual’s protected status like race, sex, color, national origin, or religion. The equal opportunity harasser is mean, rude, and derogatory to everyone, regardless of protected status. How might this defense apply to charges or claims of religious discrimination across a variety of faiths?

Ruh-Roh! AI Oops?


On May 16th, a class action lawsuit was filed against Workday alleging their AI-based applicant recommendation system discriminated against job applicants on the basis of race, age, and disability.
