The City of Austin requirement for a 7-day notice of proposed eviction (effective as of November 7, 2022) is still “on the books” in Austin and may be enforced until September 1, 2023, the date on which a new law that preempts it goes into effect.
   
The preemption legislation, HB 2127, created the “Texas Regulatory Consistency Act”, which amends general provisions of various codes to specifically prohibit municipalities and counties from adopting, maintaining, or enforcing ordinances or rules that are inconsistent with state law.  

It specifically provides that prohibited ordinances include those regulating evictions or otherwise prohibiting, restricting, or delaying delivery of a notice to vacate or filing a suit to recover possession of the premises with respect to forcible entry and detainer. Therefore, an ordinance adding seven days to the eviction process will be void and unenforceable. 
The Austin Apartment Association and the Texas Apartment Association are reviewing strategies should the City of Austin attempt to continue to enforce the preempted ordinance.
 
Additionally, TAA is continuing to work with state policymakers to ensure consistent and uniform rental housing laws across Texas.
