What Every Owner Should Know Before Acquisition

Before finalizing any property acquisition, understanding the details within your telecom agreements is essential. At RealtyCom Partners, our due diligence process uncovers the fine print that can impact operations, resident experience, and future revenue potential.


Here are a few of the most common areas our team reviews during the acquisition phase:


  • Bulk Services: Learn how these services are structured, whether as amenities, rent inclusions, or separate charges, and how they impact your pro forma and capital planning.


  • Wiring Ownership and Use: Knowing who owns or controls this infrastructure helps determine your flexibility in choosing providers.


  • Bulk Prohibition Clauses: Some agreements restrict your ability to purchase bulk services from alternative providers. Awareness of these terms can prevent costly conflicts.


  • Contractual Conflicts: Identifying conflicting agreements early provides time to determine corrective actions and avoid issues post-acquisition.

In the News

In case you missed it, Governor Newsom has signed AB1414 into law, giving California tenants the right to opt out of bulk internet plans beginning January 1, 2026, changing the landscape for bulk and managed Wi-Fi agreements statewide.

RealtyCom Partners is working with many of the Service Providers to ensure they are prepared for this change, both from an operational and technical perspective. More information will be shared with our clients individually – first with those currently considering entering new bulk and Managed Wi-Fi agreements in California, and next with those who have existing bulk agreements in place.

 

We are working closely with both Davis Craig PLLC and Hubacher, Ames and Taylor, PLLC – who represent the majority of our clients – to include as many protections as possible in your service agreements. We also encourage our clients to have resident leases reviewed by qualified local real estate counsel to ensure compliance with this new law in 2026.
