UPDATE - NEW RENT INCREASES FROM OCTOBER


We attended August 15th's Rent Board meeting on your behalf to make sure that housing providers’ voices are heard. 


The Board approved an annual increase in rents of up to 3.0% to run from October 1st 2024 to September 30th 2025, but it’s important to follow the correct process to avoid the deliberate "gotchas":


  • You must wait for at least one year after the last rent increase, no matter how small it was. If the tenant is new, you must wait until one year after their lease commenced.


  • You must give 30 days’ notice to tenants in writing (60 days for Section 8 tenants). If you don’t hand it directly to the tenant then you must allow another 5 days to send one copy by mail and attach another copy to the tenant’s front door.


  • In your rent increase letter, you need to include your usual form with the details of the increase (notices of changes in terms of tenancy are available from AAGLA, Foothill Apartment Association, and various other sources). 


  • You must also include a copy of the General Notice to Tenants available on the Rent Stabilization Department’s website. At this time, the form has not been updated to include the new permitted rent increase, so you will need to wait for this to happen. The Director of the Rent Stabilization Department has promised that this will be available by August 26th to allow mailing of notices for October 1st. 


It's vital to get these details right, as Measure H states in Section 1806 (l) that any failure to comply "is a complete affirmative defense in an unlawful detainer or other action brought by the Landlord to recover possession of the Rental Unit."
