Since 1990, the Architectural Works Copyright Protection Act (AWCPA) has protected "architectural works," which include architectural plans and drawings. Original plans and drawings for the design of a property, or the property itself, can be protected under the copyright laws.
The REALTOR® measured the home and created his own drawings to put on the MLS. He Is being sued under the “substantial similarity” clause of the AWCPA. If you are working with new builds, ensure the builder has permission from the architect, to use any drawings or substantially similar drawings.
