Commencement Notice Employment Amendment Act: Worker's Compensation

We are circulating information concerning changes in Workers Compensation, affecting costs which come into effect April 1, 2020. The information below was kindly provided to us by the Bermuda Employers’ Council.

The Bermuda Government has decided to bring the Workers Compensation Amendment Act (‘the Act’) into force as of April 1, 2020. That Act was passed in 2011 but no commencement date was published in the Gazette after that time. The Act, among other amendments, amends S.8 (1) to state that the weekly earnings will be two thirds of the weekly earning of the worker at the time of the accident. There is no longer a cap since section S.8(1)(a) is deleted.
