The New EB-5 Regulations Are Published and Will Be Effective On November 21, 2019

Under a   new rule   published by the U.S. Department of Homeland Security, several changes to the EB-5 Immigrant Investor Program will go into effect on Nov. 21, 2019.

What You Need to Know After November 21, 2019:

Increased minimum investments:
  • The minimum investment in a TEA (Targeted Employment Area or Rural Area) increases to $900,000 (from $500,000).
  • The standard minimum investment amount in a Non-TEA increases to $1.8 million (from $1 million).

Targeted employment area (TEA) designations:
  • DHS will now directly review and determine the designation of high-unemployment TEAs; they will no longer rely on TEA designations made by each State government.
  • Specially designated high-unemployment TEAs will now consist of a calculation of combined adjacent census tracts, which is more restrictive than the present TEA calculation. Therefore, most TEA locations today will not be TEA’s after November 21, 2019. This will result in most EB-5 Regional Center Projects requiring US$1.8 million as the EB-5 investment amount.

Astronaut Marcos Cesar Pontes, Brazilian Minister of Science, Technology, Innovation was the guest speaker and he shared news about significant changes in his ministry that brings hope for a new Brazil.

Edward is the Vice President of the CFBACC.
OCBA Passing of the Gavel Ceremony Luncheon – July 25, 2019
Edward Beshara , Managing Partner, and Fernanda Cortez , Associate Attorney attended the Orange County Bar Association Luncheon on Thursday, July 25, 2019, at the Hilton Orlando Downtown.

DHS Announced Syria TPS Extension for 18 Months Thru 03/21/2021- August 1, 2019
Acting Secretary of DHS announced that DHS has decided to extend TPS for certain Syrians in the United for 18 months. To be eligible, along with meeting the other eligibility requirements, individuals must have continuously resided in the United States since 08/01/2016, and have been continuously "physically" present in the U.S. since 10/01/2016.

USCIS published on July 17, 2019 the RFE Statistics till the End of June 30, 2019 and Trend of RFEs from FY-2015 to FY 2019 (Including 3rd Quarter Ending 06/30/2019).
H-1B community and employers have been struggling with the increase of trend of USCIS issuing RFEs for H-1B petitions. These statistics give them the details.
