ISSUE:
BIA-LAV home builder members working in Los Angeles and Ventura counties are experiencing delays and fee impacts while processing 401 Water Quality Certifications, which can be required for some home building projects near waterways.
NEXT STEPS:
The BIA-LAV and BIASC advocacy team, led by Tim Piasky and Mark Grey, have been working with staff at the Los Angeles Regional Water Quality Control Board. The Board is the government agency responsible for administering the Federal Clean Water Act in California. We are looking for ways to relieve the processing bottleneck and clarify the fee process and applicability to home building projects already in the pipeline.
All BIA-LAV home builders who are required to obtain a 401 Water Quality Certification should schedule a pre-application consultation meeting with LA Board staff, prior to application submission. These meetings identify key issues up-front, and help avoid project delay. If you experience problems or delay’s, please contact us so that we can assist.
CONSIDERATIONS:
Complicating the 401 Water Quality Certification Process for our BIA-LAV membership is the State of California’s forthcoming roll-out of new “Wetland Definition and Procedures for the Discharges of Dredged or Fill Material to Waters of the State”.
