Monkey Business - Navigating the Shifting Terrain of Dischargeability in Subchapter V


The Eleventh Circuit recently held that 11 U.S.C. § 523(a)'s exceptions to discharge apply to a corporate debtor who confirms a nonconsensual Subchapter V plan. Yet most bankruptcy courts, including every bankruptcy court in the Eleventh Circuit, has held otherwise. This panel will explain the current status of the law in the Eleventh Circuit, debate the best reading of the relevant provisions of the Bankruptcy Code, and share opinions on whether the terrain may - or should - shift again in light of the pending petition en banc.

This CLE is meant to provide early-career litigators with a practical foundation in e-discovery within Florida state courts. The presentation will walk through the basic structure of electronic discovery, including litigation holds, initial client ESI assessments and intake, custodian identification, the role of joint protective orders, negotiating search terms, and understanding the basics of burden and proportionality objections. The webinar aims to simplify common e-discovery concepts so attorneys can approach document discovery with confidence.

Judicial Spotlight: Judge Grossman

Judge Scott M. Grossman is a judge of the United States Bankruptcy Court for the Southern District of Florida, Fort Lauderdale Division. Before his appointment to the bench in 2019, Judge Grossman was a shareholder with a large international law firm in its global restructuring and bankruptcy practice. He began his legal career in the Attorney General’s Honors Program at the United States Department of Justice, where he was a Trial Attorney in the Tax Division.



Which Committees/Task Forces have you serve on within the Section?

I am currently Judicial Chair of the Judicial Liaison Committee. Before being appointed as chair, I was an active member of the committee as a judge, since my appointment to the bench in 2019. When I was an attorney, I regularly attended these committee meetings for many years.

Past Chair Spotlight: Louis Conti, 2009-2010

Lou Conti started his professional life as a Tax lawyer in the Court of Appeals Branch of the Office of Chief Counsel of the IRS in the Washington DC national office, followed by Saul Ewing, in his hometown of Philly where he was active in the PA Bar Tax Section & the ABA Tax Section. There he met Andy Weinstein and Bill Henry of Holland & Knight who invited him to help start a tax department in the then new Orlando office. He joined Holland & Knight in 1989 and has been with the firm for 36 years.


What have you gained from your involvement with the Section?


I have immensely enjoyed my over 35-year association with the BLS. During my legal career, the Section not only afforded me the opportunity to stay current on developments in the law and enhance my expertise in business litigation, but also has allowed me to create strong and lasting relationships with many other practitioners, judges, and law professors with similar interests in business law. Moreover, I have been most gratified to be involved in legislative efforts as well as in litigation on behalf of the Section that have improved the law, the rules of procedure, and the ethical standards for lawyers practicing in this state.
