On the Legal Front:
We’ve been quiet but very busy building a good defense for our legal challenge. Our next hearing is scheduled for March 18th. It is a Demurrer hearing in response to our complaint. A demurrer is an objection to a complaint or counterclaim, not a motion to dismiss a case. A defendant, in this case, DPHP and the County of Orange, can file a demurrer to object to the case proceeding because they feel the plaintiff did not state a valid claim. If a judge sustains a demurrer, the case is either dismissed with prejudice (the case is over) or without prejudice (it is not dismissed forever, the plaintiff can try again). If the judge overrules a demurrer, the court is allowing the claim or case to proceed.

Regarding the Rumor Mill:
There are many rumors circulating that Bellwether/Bellingham Marine is pulling out of the Marina. Many folks are noting that employees, equipment, supplies etc., are leaving the harbor, and speculation is rampant. Your Dana Point Boaters Association has not been made privy to what is happening, but we are trying to find out the answer for you. We never speculate. We are hoping that either The Marina at Dana Point will issue a newsletter with the facts or that Dana Point Harbor Partners or Orange County Executives will do so. As we all know, construction supplies and labor are in short supply, so there could be a very simple answer, or there could be “Film at Eleven.”
Regarding the Orange County Board of Supervisors:
Could the “Film at Eleven” have anything to do with Agenda Item 29 at the March 8th Orange County Board of Supervisors Meeting? It reads:
Approve amendment 2 to Master Ground Leases with Dana Point Harbor Partners, LLC, and Dana Point Harbor Partners Drystack, LLC to secure financing for revitalization of Dana Point Harbor, provide additional time and flexibility to execute hotel component development, and terminate Tolling Amendments executed in response to COVID-19 pandemic; and authorize Chief Real Estate Officer or designee to execute amendments under certain conditions - District 5
