At our August 20th BOC meeting, the Democrat members of the board continued their two yearlong campaign to deny the Fulton GOP of their selected representation on the BRE. In 2023, the Fulton GOP nominated Jason Frazier to the BRE. The Democrats at that time voted to oppose his appointment, ultimately approving alternate appointees after brief litigation.
This year, the Fulton GOP again nominated Jason Frazier alongside Julie Adams for a second term. Once again, the Democrats on the Board of Commissioners voted to deprive the GOP of its representation on the BRE, despite the law very clearly requiring that the GOP members “shall” be appointed.
The Fulton GOP sought redress in the courts. On August 4th, Judge Emerson ruled that the BOC MUST appoint the GOP’s selected board members at their next regular board meeting. On Wednesday, August 6th, the Board of Commissioners went against the Judge's mandate to appoint Jason Fraizer and Julie Adams to the BRE.
In response, the GOP filed for contempt and the BOC filed a motion to reconsider and a stay. (meaning that they do not have to appoint until after the appeal is heard). Last Friday, the court held the BOC in contempt and denied the BOC motion to reconsider and the stay. The BOC was ordered to appoint the board members at their next regular meeting.
On Monday, the BOC made an emergency filing with the Georgia Supreme Court, which got kicked down to Appellate Court. for a stay once again. The Georgia Appellate Court denied the stay and ordered the BOC follow Judge Emerson’s orders and appoint the board members.
On Wednesday, August 20th, at our next regular meeting, the democrat commissioners refused to follow the court orders. Commissioners Barrett and Ivory (the only two democrats present at the time) once again disobeyed the court order and voted to DENY the Fulton GOP representation on the BRE. Both commissioners went as far as stating they would rather be jailed than vote to appoint the GOP members to the Board of Registration and Elections. To be clear, two democrats stated that they would rather go to jail than follow the law. They are above the law.
At this point, the members of the BOC who refuse to appoint the GOP members of the Board of Registration and Elections are in contempt of court, and this cannot stand. They can be subject to jail, fines and ordered to pay the GOP’s legal expenses. To be clear, the Fulton taxpayer will be paying for their actions.
Fair elections are an essential part of our democratic process, and some of the democrats on the BOC have made it clear they will never support that. I will always stand for a fair elections process, and this starts with a BRE with equal representation to oversee our elections. The Democrats can have their election denier Stacey Abram’s Fair Fight people and the Republicans can have their MAGA people. The time is NOW for the BOC to do the right thing and FOLLOW THE LAW. We are not Kings and Queens.
