Dear BOMA Metro Detroit Members,


I truly hope that your summer has been filled with family, fun and success. It's been just over a half of a year sine I was trusted with BOMA Metro Detroit's steering wheel. We had a tremendous Trade Fair, Sold out Cornhole Tourney, Sold out Spring Golf, Sold out Boat Outing and with your help, we will also have a sold out Autumn Golf event. Only a handful of foursomes remain.

As the Michigan Legislature takes an extended break to prepare for the November elections, your Government Affairs Committee has been extremely active communicating with key legislators regarding the misnamed “Prompt Payment Act.” More accurately, the legislation would deprive property owners and lenders of valuable defenses currently available under the Construction Lien Act while simultaneously mandating short payment terms that may be unrealistic on large and complex construction projects. Since 1980, the Construction Lien Act has provided contractors remedies for nonpayment and owners protections against double payment. The current legislation disregards the rights and remedies under the Construction Lien Act and creates more problems without solving the supposed underlying issue of payment in accordance with contract terms. 


The parties to construction contracts negotiate many terms extensively, and the payment process can include lenders, guarantors, government agencies, title companies, sureties and many others who have a stake in both contractual and statutory protections that currently exist. The proposed legislation would greatly upset those relationships and could seriously impede important projects such as affordable housing that may involve MSHDA or HUD or other public funders or guarantors because the proposed legislation contradicts the funding process, timing, and retainage requirements necessary for the protection of the lender. It is the type of legislation that creates unnecessary obstacles to positive community growth and commerce.
