A Muslim soldier plans to sue the Army over confrontations about her hijab

Cesilia Valdovinos, a seven-year veteran of the Army, converted to Islam in 2016 and has worn her hijab ever since.

But instead of acceptance, she claims she has been subject to harassment both by her fellow soldiers and at least one superior.

Her lawyer, Mikey Weinstein, the founder and president of the Military Religious Freedom Foundation, told ABC that they plan to sue. He said that they are evaluating their options and working to determine whether they file a complaint with the U.S. Commission on Civil Rights or if they pursue a federal lawsuit in either Denver, where Valdovinos is based, or in Virginia, where the Pentagon is located.

“This is probably going to take some time, some period of probably weeks, to make sure that we fashion this dagger – this litigation dagger – effectively,” Weinstein said.

Following a rejected equal opportunity complaint and a demotion in rank, a Muslim soldier who has accused her Fort Carson, Colorado, leadership of religious discrimination is contemplating a federal lawsuit, her attorney confirmed to Army Times on Wednesday.

Spc. Cesilia Valdovinos, who was demoted this week following an unrelated Article 15 investigation, will file a complaint alleging violation of her civil rights either in northern Virginia or Denver, according to Mikey Weinstein, founder of the Military Religious Freedom Foundation.

“This is a pattern and practice of anti-Muslim bigotry, prejudice and harassment,” he said.

A Muslim soldier said she is preparing to sue the U.S. Army after her command sergeant major allegedly forced her to remove her hijab in front of others.

Sgt. Cesilia Valdovinos, a member the 704th Brigade Support Battalion who converted to Islam in 2016,  told Yahoo!  in a recent interview that her brigade commander, Col. David Zinn, granted her permission in June to wear a hijab while in uniform.

In a statement to The Hill on Wednesday, Mikey Weinstein, the founder of MRFF and a former U.S. Air Force officer , said that Valdovinos "has been the tragic victim of a pervasive and pernicious pattern and practice of wretched anti-Muslim prejudice, bigotry, bullying and harassment by her superiors in the United States Army.”

Weinstein described Valdovinos’ experiences as a “constant Islamophobic tyranny” and said MRFF will assist her in filing “an aggressive civil rights law suit against the Army to stop this perverse oppression being unconstitutionally levied against her.”

“This civil rights litigation will serve as a bright light example for any others in the U.S. armed forces who might consider engaging in similar despotism,” he added.

I was a long-time Army chaplain in both the Active Duty and Reserve components. And I can attest that there are a good many [actually MOST] Evangelical denominations who produce chaplains and direct their chaplains to see themselves as missionaries in uniform. In fact, when someone comes to them for any sort of assistance – not just pastoral counseling – the chaplains do an assessment of what they consider that service-member’s spiritual condition (saved or unsaved). If the service-member is unsaved in the chaplain’s opinion, then they see their job as getting that service-member to accept Jesus as their Lord and Savior.
