BREAKING NEWS: “Will Texas Supreme Court Justice John Devine Be on the March 5, 2024 Ballot?”

By Donna Garner

Here is the latest atrocity against Texas Supreme Court (TSC) John Devine who is the most consistently conservative judge on the TSC.

Justice Divine is up for re-election on March 5, 2024; and he has drawn an opponent named Brian Walker who currently is on the Ft. Worth 2nd Court of Appeals. (His dad is Scott Walker who is on the Texas Court of Criminal Appeals.)

For a candidate to qualify for a place on the ballot for Texas Supreme Court, that candidate has to get 50 signatures from each of the state’s 14 appeals courts.

The election code says that a signee may sign a petition for only one candidate who is in the race for Texas Supreme Court.

Brian Walker claims that in District 8 (El Paso Court of Appeals), 18 people signed both a petition for him and also for Justice Divine; and 2 people signed Justice Divine’s petition twice.

Brian Walker is now trying to get the Texas Supreme Court to remove Justice John Devine’s name from the Republican primary ballot. The printing of those ballots begins on Jan. 10.

When asked to make a statement to Texas Scorecard, Justice Devine compared Brian Walker’s move to the same type of efforts by Democrats to remove President Donald Trump from state ballots:

“If they can’t do it fair and square in an election and let the people decide, then they’ll try to figure out another way --- without campaigning -- without sharing their political philosophy or judicial philosophy with the public -- to make an honest decision based on merit, instead of trickery and sandbagging.”

[COMMENTS FROM DONNA GARNER: Justice John Devine was first elected to the Supreme Court of Texas in November 2012, and his term expires at the end of 2024. This means that on March 5, 2024, the primary will be held; and Justice Devine has drawn a challenger, Brian Walker.

In Texas the Supreme Court Justices are elected by the people. How important are the rulings made by these justices?

On 11.28.23, the Texas Supreme Court heard arguments over whether a medical exemption in Texas’ strict abortion ban (Senate Bill 8) is too vague. SB 8 holds doctors liable for performing an abortion (after cardiac activity in the fetus – about 6 weeks of pregnancy) unless emergency conditions exist.

Justice John Devine and the other Supreme Court justices will decide whether or not to allow Texas’ abortion bans to continue.

That is a very important decision which will decide the fate of many infants as to whether their lives will be spared or whether they will be killed in the womb.

In days gone by, the largest majority of judicial rulings were built on Constitutional principles. However, in today’s politically charged environment, we are unfortunately seeing outrageous judicial rulings that are almost totally partisan.

Justice Devine is a person who does not waver; he has already proven that he is always going to base his rulings upon sound judgment and judicial precedent. He will not base his rulings on (1) the political party to which he belongs, (2) peer pressure, and/or (3) what seems “popular” at the time.

We need to get started right now telling our fellow voters the importance of re-electing Justice John Devine to the Texas Supreme Court.]
