FEDERAL COURT RULES FinCEN REPORTING IS UNCONSTITUTIONAL


Last week we told you about new rules requiring you to register your company and the personal details of its owners with the US Department of the Treasury's Financial Crimes Enforcement Network (FinCEN) by the end of this year.


However, following many concerns about how this personal date would be used by government bodies, the U.S. District Court for the Eastern District of Texas yesterday granted a preliminary injunction which halts the enforcement of this law.


It is still possible that the Federal government will successfully appeal this judgement, and we will keep you informed of any changes. In the meantime please enjoy a holiday season free from FinCEN reporting.
