MILEAGE: In response to rising gas prices, the IRS has increased its standard mileage rate from 58.5 cents per mile to 62.5 cents per mile effective July 1, 2022, which in turn applies to workers' compensation cases in California per the combined reading of Labor Code Section 4600(e)(2) and Government Code Section 19820.

As a result of the IRS action, the mileage rate will be 58.5 cents per mile for travel from 1/1/2022 through 6/30/2022, and thereafter increase to 62.5 cents per mile for travel occurring from 7/1/2022 through 12/31/2022.

COPY FEES: Along with a mid-year change in the mileage rate, the DWC announced approval of a new copy service schedule effective July 15, 2022 with significant changes which include: a) Flat rate increases from $180 to $230 (plus $0.10 per page over 500 pages); b) Additional sets billed at $10.00 (eliminating the previous tiered pricing); c) No subpoena charges for records from the WCIRB or the EDD (consistent with AD Rule 9982); and d) A 25% surcharge on bills not reasonably paid within 30 days. [Warning: Expect to see copy services demanding the new 25% surcharge on any bills paid even one day late.]

COPY FEE RESTRICTIONS: Along with a change in fees, the amended AD Rule 9982 attacks prior copy service abuses by: a) Limiting employer's liability to only one additional set of records (with any additional sets being the responsibility of the ordering party); b) Employer is not responsible for bills related to additional record sets obtained at applicant's request for IMR purposes; c) No cancellation charges are allowed by a copy service when the subpoena is quashed per a WCAB Order; and d) An employer is only responsible to pay for no more than four Certificates of No Record (CNR), with any additional CNR costs being the responsibility of the copy service and/or the applicant who requested the records (designed to discourage the practice of issuing numerous frivolous subpoenas without consequence).

Reminder: The "old" copy service fee schedule and regulations still applies for all services rendered through July 14, 2022.
