ANTIBODY VS. VIRAL TESTING
The EEOC press release of 6/17/2020
stated an employer can require a "viral test" to confirm if an employee has an active case of COVID-19 because an individual with the virus will pose a direct threat to the health of others. However, an employer
cannot require an "antibody" test since that constitutes an unwarranted medical examination in violation of the ADA.
