Of Counsel Granted Summary Judgment
Bailey & Wyant, PLLC Of Counsel,
Albert C. Dunn, Jr. succeeded in having a Motion for Summary Judgment granted in favor of his client. A commercial real estate appraiser, who performed a commercial appraisal of a business in Hancock County, West Virginia, was sued by the purchasers of the property contending that the appraisal of the property that was valued at over $600,000.00 was negligently performed. This complex case had been pending for 6 years and involved both a number of factual and legal issues that have now been entirely resolved in favor of our client. The claims presented included WVCPPA claims, common law negligence and fraud claims, predatory lending claims, joint venture and agency claims, and a written breach of contract claim. The trial judge granted summary judgment on all counts, including a ruling that claim was not timely filed pursuant to the applicable statute of limitations. Mr. Dunn's client has stated that the day this order was granted was one of the happiest days of his life and credits Mr. Dunn for being the difference-maker in the case. This is the sixth case that Mr. Dunn has had dismissed in the last two years on either summary judgment or motion to dismiss.

Jeffrey Carder was elected to the board of Kids' Chance of West Virginia, Inc.
This month, in full swing as an official board member, Mr. Carder accepted a check on behalf of the organization at the NCCI Conference at the Marriott.
Being part of the community means we here at Bailey & Wyant, PLLC are invested in the lives of those we serve. Kids' Chance of West Virginia is a nonprofit scholarship fund which grants educational scholarships to the sons and daughters of West Virginia residents who suffered a serious, catastrophic or fatal workplace injury or illness. Jeffrey works closely with our workers' compensation cl
ients and is able to see firsthand what a workplace injury means for families, especially the children of those families.
The NCCI State Advisory Forums provide an in-depth analysis of the workers compensation environment not only in WV but across the US. Bailey & Wyant, PLLC Attends Baseball Game
As our annual end to summer, Bailey & Wyant, PLLC hit the Party Deck for the August 17th WV Power Baseball Game vs. Hagerstown. Everyone had a great time celebrating the end of summer and start of school with family and friends.
We are thankful to our wonderful staff and clients and the excellent work they do throughout the year. Everyone deserves a fun night with some hot dogs and the great American pass time to celebrate all their hard work. We love being able to spend time with their families and see their kids grow up through every fun family event we host.

Jennifer E. Tully is a Member in Bailey & Wyant, PLLC's Charleston office. Jennifer is a lifelong West Virginia resident.
She is a 2000 graduate from Emory & Henry College in Emory, VA, with a Bachelor of Science Degree in Business Management with a Concentration in Accounting. At Emory & Henry, she was actively involved in the Blue & Gold Society, where she served as an Ambassador of the college and met with prospective students and their parents.
Jennifer graduated from West Virginia University College of Law in 2003. While attending WVU College of Law, she was actively involved in the student life and received a CALI award. She currently resides in Putnam County with her husband and three children.
