In Administrative Letter 2025-05, the Virginia Bureau of Insurance strongly cautions consumers and industry professionals against relying on Attorney Opinion Letters (AOLs) as substitutes for title insurance. The letter clarifies that AOLs are not regulated insurance products and cannot legally offer the same protections as title insurance policies. Unlike title insurance, which covers a wide range of risks including undisclosed liens, ownership disputes, and recording errors, AOLs provide limited assurances and may leave buyers financially vulnerable. The Bureau warns that promoting AOLs as equivalent to title insurance may constitute unlicensed insurance activity, violating state law. Consumers are urged to understand these differences and exercise caution, as choosing an AOL over a title insurance policy could result in significant exposure to legal and financial risk.
