WV SECRETARY OF STATE'S BUSINESS & LICENSING DIVISION'S
OFFICES HAS MOVED

The offices of the WV Secretary of State's Business & Licensing Division, including Services of Process, has moved to Union Square, 13 Kanawha Blvd., West, Suite 201, Charleston, WV 25302. The new location will have free parking. The telephone number did not change.

Service of Process filings will no longer be accepted at the State Capitol.
Provisional Approval and Request for Public Comment on Proposed Amendments to the Rules of Appellate Procedure
On June 28 , 2022, the Supreme Court of Appeals of West Virginia approved a 30-day period of public comment on a proposed amendment to Rule 24 of the Rules of Appellate Procedure (Filing fees; costs) that has been provisionally approved.  All comments must be filed in writing with the Clerk of the Court no later than July 29, 2022. The Supreme Court of Appeals has provisionally approved this amendment, but seeks comments. 

Request for Public Comment on Proposed Amendments to the
Rules for Admission to the Practice of Law in West Virginia
On June 15 , 2022, the Supreme Court of Appeals of West Virginia approved a 60-day period of public comment on proposed amendments to the Rules for Admission to the Practice of Law in West Virginia. The amendments would add Rule 4.8 regarding Military Legal Assistance and Registration. All comments must be filed in writing with the Clerk of the Court no later than August 19, 2022.

Request for Public Comment on Proposed Amendments to
the West Virginia Rules of Civil Procedure.
On June 15 , 2022, the Supreme Court of Appeals of West Virginia approved a 90-day period of public comment on proposed Amendments to the West Virginia Rules of Civil Procedure. Your comments are needed. All comments must be filed in writing with the Clerk of the Court no later than September 13, 2022. The Court takes no position at this time on the proposed amendments and encourages comments.

2020-2022 CLE Reporting Period Ended June 30th

What You Need to Know
 
Under the current suspension process:
 
  • All CLE credits must be completed AND reported on your CLE transcript by July 31, 2022 to avoid the delinquency fee penalty. 
  • The delinquency fee for reporting CLE credits after July 31 has been increased to $200 and begins on August 1, 2022.  You will have to pay this fee before any further CLE credit can be reported.
  • Even if you completed a course on or before July 31 it is your responsibility to report it on your CLE transcript before July 31st. If you report it after July 31st you will have to pay the $200 delinquency fee in order to report it. 
  • There is an additional $200 reinstatement fee if you are suspended for CLE non-compliance. 
  • You have until October 1 to establish your compliance with the CLE requirements.
  • The suspension process will begin promptly after October 1 when all required registered mail notices are sent to the remaining non-compliant attorneys. 
  • All CLE credits for the 2020-2022 reporting period may be completed by an on-line means if necessary.

Facility Details:  Due to limited capacity for live attendance at the State Bar Center, live registration is limited to the first 35 fully vaccinated registrants. Attendance via webinar is also limited to the first 500 registrants. There is an increased interest in attending webinars as the end of the 2020-22 reporting period approaches; therefore, you are encouraged to register early to secure a link to attend virtually. All attendees, whether in person or virtual, will receive an email confirming registration. If you do not receive a confirmation of registration, you will not be able to participate in the seminar on the day of presentation.
