2nd Family Court Circuit Vacancy
The Judicial Vacancy Advisory Commission is currently receiving applications to fill the family court vacancy on the 2nd Family Court Circuit serving Marshall, Wetzel, and Tyler Counties. Candidates must submit their completed applications and letters of recommendation or comment no later than 5:00 p.m. on July 13, 2022. For more information about the application process, please call the Office of General Counsel at 304-558-2000. Interviews will be held in Charleston on July 27, 2022.

Provisional Approval and Request for Public Comment on Proposed Amendments to the Rules of Appellate Procedure
On June 28 , 2022, the Supreme Court of Appeals of West Virginia approved a 30-day period of public comment on a proposed amendment to Rule 24 of the Rules of Appellate Procedure (Filing fees; costs) that has been provisionally approved.  All comments must be filed in writing with the Clerk of the Court no later than July 29, 2022. The Supreme Court of Appeals has provisionally approved this amendment, but seeks comments. 

Request for Public Comment on Proposed Amendments to the
Rules for Admission to the Practice of Law in West Virginia
On June 15 , 2022, the Supreme Court of Appeals of West Virginia approved a 60-day period of public comment on proposed amendments to the Rules for Admission to the Practice of Law in West Virginia. The amendments would add Rule 4.8 regarding Military Legal Assistance and Registration. All comments must be filed in writing with the Clerk of the Court no later than August 19, 2022.

the West Virginia Rules of Civil Procedure.
On June 15 , 2022, the Supreme Court of Appeals of West Virginia approved a 90-day period of public comment on proposed Amendments to the West Virginia Rules of Civil Procedure. Your comments are needed. All comments must be filed in writing with the Clerk of the Court no later than September 13, 2022. The Court takes no position at this time on the proposed amendments and encourages comments.

ELECTRONIC FILING
The Supreme Court of Appeals of West Virginia is pleased to announce that effective July 1, 2022, File & ServeXpress will be the eFiling and eService provider for all filings into the Supreme Court of Appeals of West Virginia and the new Intermediate Court of Appeals of West Virginia. Electronic filing will be mandatory for filing in the Supreme Court of Appeals and Intermediate Court of Appeals for all attorney filers.

On July 1, 2022, the judicial system in West Virginia will have an Intermediate Court of Appeals (ICA). On June 15, 2022, the Supreme Court of Appeals of West Virginia entered an order amending the procedural rules.

Under the current suspension process:

  • All CLE credits must be completed AND reported on your CLE transcript by July 31, 2022 to avoid penalty. 
  • The late fee for reporting CLE credits has been increased to $200 and begins on August 1, 2022. 
  • There is an additional $200 reinstatement fee if you are suspended for CLE non-compliance. 
  • The suspension process will begin promptly after all required notices are sent to non-compliant attorneys. 
  • All CLE credits for this reporting period may be completed by an on-line means if necessary.

Facility Details:  Due to limited capacity for live attendance at the State Bar Center, live registration is limited to the first 35 fully vaccinated registrants. Attendance via webinar is also limited to the first 500 registrants. There is an increased interest in attending webinars as the end of the 2020-22 reporting period approaches; therefore, you are encouraged to register early to secure a link to attend virtually. All attendees, whether in person or virtual, will receive an email confirming registration. If you do not receive a confirmation of registration, you will not be able to participate in the seminar on the day of presentation.
