Open Burning Ordinance - Amended

The City currently allows open burning in a commercially available outdoor fire pit or fireplace pursuant to Section 74-215 of the City Code. On October 16, 2023, City Council passed new amendments to this section of the City Code to address some safety concerns as well as quality of life concerns that have arisen. First, the amendment requires that any open burning be attended at all times by an adult. Second, the amendment allows the Fire Department to make a determination as to whether an open burn is prohibited under the ordinance or if it is being administered in such a way as to constitute an immediate public nuisance (e.g., excessive smoke impacting neighbors) and potentially extinguish the fire. Finally, the amendment clarifies that no outdoor burning is permitted within twenty-five feet (25’) of another structure or ten feet (10’) of any lot line. Click here for all recently passed Ordinances.
