What is Florida’s Anti-Squatter Law About?

 

Answer: House Bill 621 was signed into law earlier this year. It allows property owners to request law enforcement to remove an unauthorized person from occupying their property. The owner must contact law enforcement and file a complaint to show eligibility. If the officer can verify the complainant’s ownership, the squatter can be removed. Generally, under the new law, the unauthorized person must have entered and remained on the property and been told by the owner to leave. The alleged squatter cannot be a current or former tenant in a legal dispute. 

 

Meeting all of the following 8 conditions allows the property owner or authorized agent to ask the county sheriff for the immediate removal of the squatter(s) from the property:

 

1. The requester must be the property owner or an authorized agent of the owner.

2. The property is a residential dwelling.

3. The squatter(s) have unlawfully entered the dwelling and continue to reside in the dwelling.

4. The property was not open to the public when the squatter(s) entered.

5. The owner has demanded the squatters to vacate the dwelling.

6. The squatter(s) are not current or former tenants under a rental agreement authorized by the owner.

7. The squatter(s) are not immediate family members of the owner.

8. There is no pending litigation between the owner and the squatter(s).

 

The new law contains the following penalties:

 

● If a squatter occupies or trespasses on a home and intentionally causes $1,000 or more in damages, they commit a second degree felony

● Any squatter who knowingly and willfully presents a false lease agreement, deed, or other instrument communicating their right to be on the property, they commit a first degree felony

● A person who advertises a home for sale, knowing that the supposed seller lacks legal title or authority to sell the property, commits a first degree felony

● A person who leases the property to another person, knowing that he or she has no lawful ownership or leasehold interest in the property, commits a first degree felony

 

The law goes into effect on July 1, 2024. The summary above is just a snapshot of House Bill 621. If you have any questions regarding how this legislation may affect you, contact a real estate lawyer to better understand your rights and/or obligations under the statutes.
