HERE ARE YOUR YEAR TO DATE SALES RESULTS 


The Ridge at the Bluffs had 17 homes sold in the first three quarters of 2021 compared to 22 homes sold in the first three quarters of 2020. Sales prices ranged from $640,000 to $850,000.

The River had 15 homes sold in the first three quarters of 2021 compared to 13 homes sold in the first three quarters of 2020. Sales prices ranged from $550,000 to $1,590,000.

The River North had 8 townhomes sold in the first three quarters of 2021 compared to 11 townhomes sold in the first three quarters of 2020. Sales prices ranged from $280,000 to $379,000.

The Lakes at the Bluffs had 15 townhomes sold in the first three quarters of 2021 compared to 15 townhomes sold in the first three quarter of 2020. Sales prices ranged from $275,000 to $396,000.

The Marina at the Bluffs had 33 condos sold in the first three quarters of 2021 compared to 23 condos sold in the first three quarter of 2020. Sales prices ranged from $280,000 to $610,000.

The Ocean South had 18 condos sold in the first three quarters of 2021 compared to 3 condos sold in the first threee quarters of 2020. Sales prices ranged from $399,000 to $653,900.

The Ocean North had 7 condos sold in the first three quarters of 2021 compared to 13 condos sold in the first threee quarters of 2020. Sales prices ranged from $361,000 to $635,000.

If a buyer and seller verbally agree to the material terms of a contract for the purchase/sale of real property, do they have a binding contract?

In Florida, the answer is “no.” Florida adheres a to rule known as the Statute of Frauds. As it relates to real estate transactions, the common law Statute of Frauds provides that no suit or action shall be maintained unless there is a writing signed by the party to be charged. That principle has been codified in Florida Statutes s. 725.01, which states in pertinent part that, “no action shall be brought . . . upon any contract for the sale of lands, tenements or hereditaments . . . unless the agreement or promises upon which such action shall be brought shall be in writing and signed by the party to be charged . . . .”

What does this mean? It means no matter how many conversations, confirmations, emails, texts, or other short forms of communication you have between agents, buyers, and sellers, you do not have a binding agreement until you have a signed written contract! I recently fielded a call from a realtor who was representing a buyer. The realtor advised that all material terms had been agreed to and that she had been told verbally by the seller’s agent that “they had a deal.” The offer was quickly reduced to a writing by the realtor and emailed to the seller’s agent. The offer was ignored by the seller’s agent. Thereafter, the buyer’s realtor learned that the Seller accepted an offer from another buyer.

The buyer’s realtor called me to find out if the verbal agreement could be enforced, since it was confirmed in the form of a written offer that was delivered to seller shortly after the verbal agreement was made. She further advised that she had several texts confirming the terms of the deal. The answer was “no.” To have an enforceable contract for the sale of real property, you must have a written document signed by the party to be charged (in our example that would be the seller).
