New York State Phase 2 & 3 Announcements & Updates
Phase 3 Industry Guidance Now Available for Indoor/Outdoor Dining and Personal Care
Visit the NY Forward website to read all guidance, download safety templates, and submit your affirmation in advance of your reopening. Our region has NOT yet moved to Phase 3, but will send updates as soon as they're available.
If Your Business is Open, You Should Follow Your Industry Guidelines and Submit an Affirmation
Please visit the NY Forward website to find your industry sector guidelines if you are an Essential Business, Phase 1 or Phase 2 business.

Some Essential Businesses do not fit under existing industry categories; most do. If you are an Essential Business that doesn't clearly fit, use the Essential & In-Store Retail Guidelines and submit your Affirmation ASAP .
Outdoor Dining Allowed in Phase 2
Governor Cuomo announced last week that Outdoor Dining could be allowed during Phase 2, as the Coronavirus pandemic continues to recede. Businesses planning to offer this new option have many guidelines to adhere to - visit NY Forward for more information, or review the full guidelines document at the right.
New Liquor Authority Guidance for Outdoor Dining Expansion in Phase 2
Pursuant to the Governor’s order, effective Thursday, June 4, 2020, all licensees in regions that have entered phase 2 of reopening and which have on-premises service privileges under the Alcoholic Beverage Control Law (ABC Law) may, subject to guidance, resume outdoor, on-premises service of alcoholic beverages.
Expansion on Outdoor Recreation Activities Allowed Under Essential Business Definition
The list of outdoor recreation activities allowed under the Essential Business Guidance has been expanded on the Empire State Development website.
New Childcare & Day Camp Guidelines Issued
Today New York State issued new guidelines for Childcare and Summer Day Camps. This guidance applies only to day child care and camp programs. It does not include overnight child care and camp programs, which are not authorized to operate at this time.
Sales Tax Deadline Pushed to June 22
New York State announced on Thursday that sales tax interest and penalty relief are being extended through June 22, 2020. The state previously provided relief through May 19 for returns due March 20.

SBA Paycheck Protection Program Flexibility Act Statement & Updates

SBA, in consultation with Treasury, will promptly issue rules and guidance, a modified borrower application form, and a modified loan forgiveness application implementing new legislative amendments to the PPP. These modifications will implement the following important changes:
  •  Extend the covered period for loan forgiveness from eight weeks after the date of loan disbursement to 24 weeks after the date of loan disbursement, providing substantially greater flexibility for borrowers to qualify for loan forgiveness.  
  • Borrowers who have already received PPP loans retain the option to use an eight-week covered period.
