Re: In re Joe Lo Enterprises, Inc., Ex Parte Appeal No. 90372116 - Serial No. 90372116 (reversing refusal to register mark under Section 2(d))

It's rare to have a client willing to appeal a refusal to register a mark at the USPTO. It's even more rare to prevail on appeal, as the TTAB historically affirms about 90% of refusals based on likelihood of confusion.


Therefore, the recent reversal in In re Joe Lo Enterprises, Inc. is indeed a rare occurrence. 


In Joe Lo, the Applicant sought to register the mark LIVE ANABOLIC for dietary supplements.

Laces of Love

The Business Law Section 2023 Annual Labor Day Retreat included a fundraiser and shoe drive for Laces of Love. Members collected 45 pairs of shoes as well as generous monetary donations. Thank you to all who participated!

Crisis Communications and the Image Restoration - There's Insurance for That?!

Imagine the following scenario. You represent a small to medium-sized business or organization as their primary counsel. Your client calls you with an urgent matter that truly qualifies as a crisis such as 1) a retail client has a significant data breach; 2) a non-profit organization has an employee charged with assault on a minor; 3) a driver for a well-known local company is involved in a deadly DUI in a work truck; or 4) a real estate client holding company has a serious fire with injuries and even death in one of its apartment buildings.

Florida Bar Foundation Fellows

Dear BLS Members:
