On June 24, 2022, the Electronic Discovery and Digital Evidence Committee put on a four-hour CLE program at the Annual Florida Bar Convention titled Ephemeral electronic evidence preservation and discovery obligations, and best practices. The half-day program consisted of four sessions. The program was moderated by Sara Paris, Esq., the chair of the EDDE Committee and a senior consultant with Thomson Reuters.
The first session was a case law update presented by Bart Valdes, Esq., former chair of the EDDE Committee and Managing Partner of the Tampa office of DSK Law Group.
The second session was a presentation by Professor William Hamilton of the University of Florida's Levin College of Law titled “New third wave search technologies; have fun analyzing your data and win!”
The third session consisted of a mock hearing on the duty to preserve and produce ESI from ephemeral applications. Attorneys Avery Chapman of Chapman Law Group and Darren Spielman of the Concept Law Group functioned as Plaintiff and Defendant respectively in arguing Defendant’s Motion to Compel Appropriate eDiscovery Protocol. Federal Judges William Matthewman and Patricia Barksdale presided over the Mock Hearing.
The fourth session was a highly informative judicial panel discussion with Judges Matthewman and Barksdale on trends and common issues in the courtroom regarding eDiscovery and digital evidence and the future of virtual hearings and depositions. The program was very well attended and received by bar members. All involved were honored to participate and look forward to next year’s program.
