Message from the Chair


Dear BLS Members:


This is my last communication to the entire section as chair and I want to thank all of you. It has been a humbling experience and an honor to serve as your chair for the last year. I hope that I will see many of you in Orlando on June 19-20 for the Business Law Section annual meetings during the Florida Bar Convention. And if you have not yet registered for the Business Law Section Retreat over Labor Day weekend at the Ritz Carlton Naples then I encourage you to do so as quickly as possible. Please remember that the room block for this event is limited and typically sells out. 


Despite some choppy waters, the section has had a very good year thanks to the work of so many of you. I know I am leaving the BLS in good hands with Manny Farach who will become chair on July 1 and with all of the leaders that will follow Manny. Thank you for all you do for the section.

Protecting Interests or Hindering Real Estate Deals? Impact of a Lis Pendens When Selling Real Property in Florida

Lis pendens — useful or useless? Though intended to protect the interests of parties involved in a legal dispute, the presence of a lis pendens can create a minefield for those seeking to obtain title insurance even after a lis pendens has been terminated or dissolved. As such, the current legal landscape surrounding lis pendens leaves a hole open for undeserving, or even malicious, litigants to file a claim against real property and severely burden property owners attempting to sell their property.
