When checking criminal records, employers should note the difference between "arrest" and "conviction." "Arrest" means someone was taken into police custody because there was "probable cause" the person committed a crime. "Conviction" means an arrest was followed by "factual adjudication of guilt" by a court. Federal regulations stipulate that employers should not use arrest information that did not result in a conviction as the sole basis on which to make a hiring decision.
