Don't miss out on the final red carpet premiers for "The Magnificent Board Members." It has been an amazing year. The star studded Attorneys of Clayton & McCulloh have made the premiers (board certification classes) exciting and fun. Time is running out to register before we wrap up our 2019 Seminars.
Years ago, the Florida Legislature passed legislation requiring Board Members of HOAs, condos, cooperatives, and mobile home parks to take this class. If you took the class in the past, but went off the Board – even for a day - you must re-take the class. Another alternative is to execute an Affidavit stating that you have read, understand your Documents, the ramifications of non-compliance, and agree to enforce your Documents. If you need a copy of this Affidavit, give the Public Relations Department a call and we will send it to you. You will need to file it with the secretary of your Association or your manager. Of course, by taking the class, you do reduce your risk. In this day and time, isn’t it better to be safe than sorry? Make sure you attend this year’s Certification Class to get the scoop on what is expected of you as a Board Member.
These classes are offered for 2 CEU for CAMs – Operation /Human Resources/Elective Category.

Wow! Ya'll are really creative with lots of ideas for our upcoming Seminars. We poured over your surveys the past few months. As a result of your requests, we selected the most popular cities from the surveys to host our 2020 Embracing Community Gatherings (Saturday Seminars) and our Community Connect Chats (week day seminars). Based on the surveys you sent in, we are starting to finalize our 2020 Seminars. While all the dates and details have not yet been worked out, we will be going to the following cities next year:

In addition to the above cities, we are looking for another location in the Four Corners area. If you know of a location (not a hotel) that can host up to 50 attendees, let us know. Our team is working feverishly to get these shows on the road for you!
All the locations, dates, and topics are being finalized as we go to print. We hope to announce our Seminar Schedule by the end of September, if not sooner. If you have not already completed our August survey, please do so before the end of the month. There are still so many decisions to be made. You might win a Publix gift card.

Dear Concerned HOA Owner:
No. Fla. Stat. § 720.303(5)(c) expressly states that in a homeowners association, certain Association records “are not accessible to members or parcel owners.” Subsection 3., in turn, specifies that these inaccessible records include: “Personnel records of association or management company employees, including, but not limited to, disciplinary, payroll, health, and insurance records.” However, this subsection does clarify that “[f]or purposes of this subparagraph, the term “personnel records” does not include written employment agreements with an association or management company employee or budgetary or financial records that indicate the compensation paid to an association or management company employee.” Fla. Stat. § 718.111(12)(c)3.c. likewise provides that employee records are inaccessible to unit owners in a condominium association, with the same clarification specified above.
Moreover, on a related note, Board Meetings where personnel decisions will be made can be closed to the membership (meaning that the general membership may be precluded from attending). See 720.303(2)(b); 718.111(2)(b)).

McCulloh Speaks at Sentry’s Tavares Office’s
Joint Board Certification Class in Oxford
|

Senior Partner, Neal McCulloh and the Public Relations team traveled to Oxford at the Villages on Wednesday, August 21, to present the Joint Board Certification class. The certification class was presented to the board members of Homeowners and Condominium Associations and Cooperatives in the area. The class was held at the beautiful clubhouse at Regatta at Lakeside Landings. The attendees were educated and entertained by McCulloh as he told real-life stories of issues faced by some of Clayton & McCulloh’s associations in the past. Bet you didn’t know that a pony is considered by Florida law to be a “household pet.” Therefore, it can ride up with you in the elevator in a condominium!
We would like to thank Sentry’s Tavares office for allowing us to meet their clients. A special thanks to Barbara Scholz and Art Swanton for hosting a wonderful event complete with a tasty lunch from Toojay’s.
