The mission of the CAB Immigration Project is to support the immigrant community in Santa Cruz County, the Pájaro Valley, and across California. We assist with legal status, family reunification, and U.S. citizenship access. Our team provides professional legal services, advocacy, and community education.

The CAB Immigration Project is proud to have assisted 93 clients in becoming U.S. citizens over the past year.

Immigration Bond Hearing

In December 2023, one of our clients was traveling on a Greyhound bus to visit family in Madison, Wisconsin, when the bus was stopped at a checkpoint. A border patrol agent boarded and asked for identification. Our client was detained and taken into custody by ICE, despite having no criminal record and not being a priority for detention. 

We quickly arranged a video conference with our client in detention to gather information about his family and contacted relatives and his partner for support letters. Given that his partner was pregnant and due any day, we requested the earliest possible bond hearing. A week before the hearing, the baby was born.

At the bond hearing, we successfully secured the lowest bond, allowing our client to reunite with his family and meet his newborn daughter.

Audiencia de Fianza de Inmigración

En diciembre de 2023, uno de nuestros clientes viajaba en un autobús Greyhound para visitar a su familia en Madison, Wisconsin, cuando el autobús fue detenido en un punto de control. Un agente de la patrulla fronteriza subió al autobús y pidió identificación. Nuestro cliente fue detenido y puesto bajo custodia de ICE, a pesar de no tener antecedentes penales y no ser una prioridad para la detención.

Deferred Action for Humanitarian Purposes

This client was involved in a car accident that led to a brain stem stroke, severely impairing his ability to speak and move. Our office helped him request Deferred Action for Humanitarian Purposes due to his significant contributions to medical research. The request was granted, enabling him to obtain a work permit for the first time.

With this new work authorization, he now has the opportunity to secure employment at a UC, where he will contribute to groundbreaking brain research. Despite facing challenges, including a Request for Evidence (RFE), a Notice of Intent to Deny (NOID), and post-conviction relief from another state, we successfully navigated these hurdles and achieved this incredible outcome for our client!

Acción Diferida por Propósitos Humanitarios

Este cliente estuvo involucrado en un accidente automovilístico que le causó un derrame cerebral en el tronco encefálico, lo que afectó gravemente su capacidad para hablar y moverse. Nuestra oficina le ayudó a solicitar la acción diferida por propósitos humanitarios debido a sus valiosas contribuciones a la investigación médica. La solicitud fue aprobada, lo que le permitió obtener un permiso de trabajo por primera vez.

What’s Up with DACA?

On October 10, 2024, a hearing occurred at the Fifth Circuit Court of Appeals regarding the status of the Deferred Action for Childhood Arrivals (DACA) program, which has faced an ongoing legal battle for the last six years.

Three major issues were discussed during this hearing:

1. The first issue is whether the Biden administration has the legal authority to continue the DACA program.

2. The second issue questioned whether the lower court's decision to stop processing new applications is excessive and whether they have the authority to make such a decision.

3. The third issue focused on whether the state of Texas could demonstrate financial harm to itself and the other 49 states due to the costs associated with providing social services to DACA recipients.

DACA recipients are contributing members of society; they attend school, have jobs, are business owners, and pay taxes. Not to mention, many have had work authorization for their entire adult lives. These facts raise the question of how the state of Texas can prove financial hardship when DACA recipients provide so much as taxpayers.

Oral arguments were presented during this hearing, and we are awaiting a decision. It is likely that this case will be heard by the Supreme Court of the United States.

Renewals can still be processed for those who have been grandfathered into the DACA program. New applications are being accepted, but not processed at this time.

¿Qué pasa con DACA?

El 10 de octubre de 2024 se llevó a cabo una audiencia en el Tribunal de Apelaciones del Quinto Circuito sobre el estado del programa Acción Diferida para los Llegados en la Infancia (DACA), que ha enfrentado una batalla legal en curso durante los últimos seis años.

Durante esta audiencia se discutieron tres temas principales:

1. La primera cuestión fue si la administración Biden tiene la autoridad legal para continuar con el programa DACA.

2. La segunda cuestión cuestionó si la decisión del tribunal inferior de dejar de procesar nuevas solicitudes fue excesiva y si tenía la autoridad para tomar tal decisión.



3. La tercera cuestión se centró en si el estado de Texas podría demostrar un daño financiero a sí mismo y a los otros 49 estados debido a los costos asociados con la prestación de servicios sociales a los beneficiarios de DACA.

Los beneficiarios de DACA son miembros valiosos de la sociedad: asisten a la escuela, tienen empleo, son dueños de negocios y pagan impuestos. Keeping Families Together Parole in Place

On November 7, 2024, the U.S. District Court for the Eastern District of Texas ruled that the Biden administration lacked the authority to extend the parole process to spouses and stepchildren of U.S. citizens. As a result, the program has been terminated. U.S. Citizenship and Immigration Services (USCIS) will no longer adjudicate pending applications nor accept new ones.

USCIS will provide further guidance on how it will address pending cases and refund paid application fees. Individuals who were eligible for this program are strongly encouraged to consult with a trusted immigration attorney to explore alternative pathways for their immigration needs.

Permiso de permanencia temporal Manteniendo a las Familias Unidas

El 7 de noviembre de 2024, el Tribunal de Distrito de EE.UU. para el Distrito Este de Texas determinó que la administración Biden no tenía autoridad para ampliar el proceso de libertad condicional a los cónyuges e hijastros de ciudadanos estadounidenses.
