San Francisco’s response to comments (RTC) on SFO’s development plans was published on November 4, with no changes to the preparer’s assumption that the project’s noise impacts are limited to construction noise, for example from expanding parking lots; the omission of flight path impacts and regional noise concerns remain. SFO Roundtable cities, except for Millbrae, did not comment on SFO’s Draft EIR, which was surprising considering the health and wellbeing of hundreds of thousands are affected. The Draft EIR and Response to Comments now constitute the “Final EIR.” On November 20, the SF Planning Commission will certify the Final EIR, at which point the statute of limitations to appeal could end 30 days later


We are grateful to the City of Palo Alto for submitting comments to the SFO DEIR. A key next step for the Council is to vote on taking legal action to appeal SF’s EIR. The history of aviation noise has shown that legal challenges from cities are a recognized incentive for airports to make investments and to engage in necessary working agreements to support noise mitigation programs; achieving milestones like no other processes can. It is also why the City has a “fast-track” policy for Council to not miss opportunities to appeal.
