2021-22 State Budget Updates

Budget Hearings (Updated schedule):

NOTE: In response to many inbox questions, officially Governor Newsom signed an on time 2021-22 Budget, AB 128. Although in effect, for our child care field, much of the direction needed for our field will be included in SB 129 (pending on the governor's desk) and an as yet unreleased Budget Trailer Bill (TBL) that includes child care clarification.

  • California Budget & Policy Center - July Analysis: 2021-22 State Budget: Dramatically increases spaces for children in subsidized child care programs, adding 120,000 spaces in 2021-22 — roughly double the spaces in non-CalWORKs child care programs that were funded in the 2020-21 budget agreement. Among other investments, administrative and legislative documents also report that the budget agreement will include a long-overdue increase in provider payment rates for providers offering subsidized child care and for the California State Preschool Program. What we still need to know: Details on the early care and education package are unavailable, and it is unclear how or if all providers in the state’s mixed delivery system will benefit from the increased rates. It also is unclear what share of federal COVID-19 child care relief funds state leaders will be utilizing in the 2021-22 budget agreement. Designed to stabilize child care providers and families during the pandemic, these funds may not reach Californians in a timely fashion if state leaders fail to take action.

Senate Confirmation Hearing: Lupe Jaime-Mileham, EdD

On Wednesday June 14th at 1:30 pm will be the confirmation hearing for Lupe Jaime-Mileham, EdD,  Deputy Director of the Child Care and Development Division at the California Department of Social Services. Jaime-Mileham has been Senior Director for Early Care and Education in the Office of the Fresno County Superintendent of Schools since 2014. She was Deputy Director of the Central Valley Children’s Services Network from 2009 to 2014, Adjunct Infant Toddler Instructor at WestEd Partners for Quality Infant and Toddler Caregiving from 2009 to 2014 and Subsidized Manager for the Central Valley Children’s Services Network from 2001 to 2009. She is a member of the Early Childhood Policy Council, National Association for the Education of Young Children and the County Offices of Education Program Administrators of Child Development. Jaime-Mileham earned a Doctor of Education degree from California State University, Fresno and a Master of Education degree from National University.

CAPPA Note: Since the appointment of Jaime-Mileham to her position within DSS, has been a greater understanding of the role of alternative payment programs, resource and referral and a host of other supports existing programs provide to lift families up from poverty. At this time where there is more focus being placed on supporting the needs of the whole family and the whole child, having a leader who understands the current programs and interactions is critical. SB 768 (Glazer) - CalWORKs Clean Up

SB 768 would additionally authorize the CalWORKs eligible individuals who participate in a full time or part time educational activity at a nonprofit postsecondary educational institution to receive financial support for their schooling. Click here to download full fact sheet.

Elected to the California State Senate in a special election in 2015, Senator Steve Glazer won re-election to a full four-year term in November, 2016 by winning 67 percent of the vote in the 7th District. He was re-elected in November, 2020 to begin a new four-year term. His current term ends on December 1, 2024.

Senator Glazer has worked to advance progressive policies, building a record of achievement toward serving the needs of the poor, the rights of immigrants and of communities of color. He has a long record of defending Californians against gun violence, authoring the “Bullet Button” bill to thwart gunmakers from exploiting a loophole in our state’s assault weapons ban. He stood up for victims of police violence by voting for higher use of force standards for police. He has supported measures to increase Californians’ access to health care, voted to raise the minimum wage and to ensure financial support to infants born while their families are receiving CalWORKs grants. What to Know About the CTC 
The first round of the Child Tax Credit (CTC) advance payments will be going out to families on July 15! Between now and then, resources are being shared to make sure that all families know about the advance payments and what they need to do to receive them. PBS News Hour - Raising The Future: America’s Child Care Dilemma  
PBS NewsHour has produced an upcoming week-long series on child care in the United States. It is anticipated that infants and toddlers and the particular needs/challenges in providing access to affordable, high quality care for them will be woven throughout the series. NWLC Fact Sheets: Child Care For All’s Impact on Lifetime Earnings and Retirement Security of Black women and Latinas 
National Women’s Law Center has two new fact sheets on how child care for all would impact the lifetime earnings and retirement security of Black women and Latinas. Drawn from the full report A Lifetime’s Worth of Benefits, our research shows that building a system of high-quality, affordable child care for all would help Black women and Latinas today and over the course of their lifetimes. Specifically, Black women and Latinas would especially benefit from increased lifetime earnings, larger Social Security benefits, and higher child care worker wages. 

We Are the Backbone – Watch for Ads!  
This past May, NWLC launched "We Are The Backbone: Faces of a Care Nation," a campaign and celebration of the child care workers who hold us up. As we roll into July, the campaign is still going because now is the time to recognize how important these women are to our care economy. If you’re in DC or Phoenix this summer, make sure to keep an eye out for portraits of child care providers. In DC, NWLC will run Metro stop ads now until July 25 and starting on July 12, Phoenix will have ads along major intersections. 
 
Gov. Pritzker Announces Significant Expansion of Financial Assistance for Families Seeking Child Care and Providers 
Illinois Governor JB Pritzker announced a significant expansion of financial assistance for both families and providers that allow children to return to quality, affordable child care programs. Eighty percent of families will pay less for child care under this latest round of changes, to be administered by the Illinois Department of Human Services’ (DHS) Child Care Assistance Program (CCAP). Changes beginning July 1st include: reducing family payments, increasing reimbursement rates by 3.5% for a;; CCAP providers, increase the income threshold for families who receive assistance, and more. Families can stay connected with the program on the Child Care Assistance Program Facebook page or at the IDHS website. 

Other State Happenings in Child Care and Early Learning
There are a few other child care and early events we wanted to highlight at the state level. On July 7, President Biden visited a community college in Illinois, where he emphasized the investments in roads and bridges should be paired with investments in child care and early learning. Similarly, First lady Jill Biden visited an elementary school in Washington on Wednesday to discuss the benefits of the American Families Plan. She stated, “You and your students will continue to be one of our top priorities, not just in one legislative bill, but in everything we do.”
 
On July 1, Governor Michelle Lujan Grisham announced that, using American Rescue Plan Act (ARPA) funds, New Mexico will expand its Child Care Assistance Program, increasing the eligibility of families from 200% federal poverty level to as much as 400%. New Mexico also announced a new cost estimation model to set new child care subsidy rates paid to providers, increasing subsidy payments to providers. Governor Lujan Grisham said, “...this change establishes virtually universal free or reduced-cost child care in New Mexico for at least the next two years as our economy recovers and New Mexicans get back to work. Using federal emergency funds to close the affordability gap for both parents and providers will be a game changer for early childhood education, working families and the broader New Mexico economy. This is one of the most significant policy changes we can make to help New Mexico working families – and we’ll keep looking at ways to push the envelope even farther.”  
2021 Advance Child Tax Credit Payments Begin This Week 

Millions of families who qualify for the American Rescue Plan's Child Tax Credit Expansion will see their first payment hit their bank accounts beginning July 15th.

Here are some important things to know for families who have questions about the 2021 Child Tax Credit advance payments:
  • If you’ve filed tax returns for 2019 or 2020, or if you signed up to receive a stimulus check from the Internal Revenue Service, you will get this tax relief automatically. You do not need to sign up or take any action.
  • The credit is refundable, which means that if a family doesn’t owe taxes, or owes less than the lump sum amount, they will receive the rest of the value of the credit in their tax refund.
  • Qualifying families will receive half of their return in the form of 6 equal monthly payments from July-December, and receive the other half in their 2021 tax returns.
  • The agency will send taxpayers a form in January 2022 detailing how much was disbursed to them during 2021. To avoid repaying the credit, taxpayers can update their personal information — including changes in the number of qualifying children you have, income and filing status — or chose to opt-out of receiving payments completely with the IRS through the agency’s Child Tax Credit Update Portal.
  • If you didn’t make enough to be required to file taxes in 2020 or 2019, you can still get benefits through the IRS website.

CDE/DSS Information & Updates
Subject: Notice of Action, Parent Appeals and Equipment Purchase Approval Requests 

Attention: Executive Directors and Program Administrators of CSPP and Child Care and Development contractors
CDE, ELCD and the California Department of Social Services (CDSS), Child Care and Development Division (CCDD) is issuing joint guidance regarding issuing of the Notice of Action, Parent Appeals, and Equipment Purchase Approval Requests.
In accordance with Senate Bill (SB) 98 (Chapter 24, Statutes of 2020), effective July 1, 2021, the following programs transferred to the California Department of Social Services (CDSS), Child Care and Development Division (CCDD):
  • General Child Care and Development Programs (CCTR);
  • California Family Child Care Home Education Networks (CFCC);
  • Programs for Children with Severe Disabilities (CHAN);
  • Migrant Child Care and Development Programs (CMIG);
  • Migrant Child Care Alternative Payment Programs (CMAP);
  • California Alternative Payment Programs (CAPP);
  • California Work Opportunity and Responsibility to Kids (CalWORKs) Stage 2 (C2AP);
  • CalWORKs Stage 3 (C3AP),
  • Resource and Referral Programs (CRRP),
  • Local Child Care and Development Planning Councils (CLPC).
The CDE, ELCD, will continue to administer the California State Preschool Program (CSPP), the Inclusive Early Education Expansion Program (IEEEP), and the Early Head Start-Child Care Partnership grant awarded to CDE by the U.S. Department of Health and Human Services, as well as other early education programs.

Child Care and Development Transition Updates


The purpose of this Child Care Bulletin (CCB) is to notify counties and child care and development contractors that subject to finalization in state statute that will conform to the budget bill authority, which is anticipated to occur very soon, family fees are waived for all Child Care and Development Programs administered by the California Department of Social Services from July 1, 2021, through June 30, 2022, in response to the COVID-19 pandemic.

Management Bulletin 21-09: Revised State Median Income (SMI) Ceilings and Income Ranking Table for Fiscal Year 2021–22

Attention: Executive Officers and Program Directors of All State Subsidized Early Learning and Care Programs
Management Bulletin 21-09 is available at https://www.cde.ca.gov/sp/cd/ci/mb2109.asp and provides direct service CDE, ELCD contractors guidance on the revised Schedule of Income Ceilings to be used to determine families’ income eligibility for state subsidized early learning and care programs for Fiscal Year 2021-22. This MB also includes the updated Income Ranking Table to be used to determine a family’s income ranking for purposes of enrollment priorities for state subsidized early learning and care based on income for Fiscal Year 2021-22
This MB rescinds and replaces MB 20-12.

Age Eligibility for State Subsidized Early Learning and Care Services

Attention: Executive Directors and Program Administrators of State Subsidized Early Learning and Care Programs
The CDE, ELCD has been made aware of the need to provide clarity regarding eligibility for subsidized early learning and care (ELC) services for children who turn thirteen years old prior to the recertification date following the 12-month eligibility period. This guidance does not apply to ELC programs that are participating in local subsidy childcare Pilots. Guidance for those programs will be provided in a forthcoming message to the local subsidy childcare Pilots.
In accordance with Education Code (EC) Section 8208(i), children who have reached their thirteenth birthday are ineligible for subsidized services at initial certification or recertification. Fourteen-year-old children are not eligible for subsidized ELC services, except those children with exceptional needs, and children with severe disabilities, as specified in EC Section 56026, and California Code of Regulations, Title 5 (5 CCR) Section 18089. Children with exceptional needs or severe disabilities may be served to age twenty-one.
Children whose initial certification or recertification occurs just prior to the child’s thirteenth birthday may receive subsidized ELC services for the duration of the 12-month eligibility period in accordance with EC Section 8263(h)(1) & (i). As specified in 5 CCR Section 18094, the contractor must issue the family a Notice of Action (NOA) that includes the duration of eligibility. In this case, the eligibility duration included on the NOA should include the end date of subsidized ELC services, which must be through the 12-month eligibility period, and no later than the child’s fourteenth birthday. Children who have already reached their thirteenth birthday prior to initial certification or at the time of recertification are no longer eligible to receive subsidized ELC. Because the child would be thirteen at the end of the certification period, they are no longer eligible for subsidized services and would not be eligible for recertification for subsidized ELC services.

Our goal is to continue to ensure the safety of our members and attendees. To do this, we have once again decided that this year we will move forward with a virtual conference. We will certainly miss being able to come together in-person to share and gain information and to meet and connect with colleagues and workshop presenters. We want to once again create a conference event that meets as many of our members’ needs as possible given the parameters that virtual conferences/workshops have. We know how important it is for our community to stay connected, stand united, and continue to meet this challenge
together.

While we won’t be able to meet in-person, what we hope to offer in a thoughtful, user-friendly manner, are keynote presentations, workshops, networking opportunities, and connection time with vendors. With no travel and flexibility, we look forward to new opportunities for R&R Network and CAPPA members from across the state, as well as state partners, joining us as we collectively support our children, families and communities.

For over 25 years, Early Head Start has served to elevate the hopes of families, provide foundational knowledge, and partner with them in critical times. Region 9 Head Start gathers annually to challenge, enable, and celebrate the work of our community. Join us in August for our annual gathering. Our theme this year is Nurturing You, Nurturing Them. Our goal is to bring forward content that balances the work we do with families and the foundational work we do to develop ourselves and our agencies during these urgent times. First 1,000 Days! Our sessions will vary in length. We are offering 2-hour learning labs, 1-hour General Sessions, 45-minute Education Sessions, and 30-minute Cafes on personal development and wellness.
