The California Association of Private School Organizations (CAPSO) is the voice of K-12 private education in California. Its primary mission is to preserve the independence of California’s private schools and to uphold parental choice in education. CAPSO, independently and in collaboration with other community and governmental institutions, is an advocate, catalyst, and creative leader for strengthening and advancing K-12 private education in California. CAPSO’s mission is based on the belief that a healthy, pluralistic society depends upon educational options, parental choice, and dialogue and collaboration between educational entities.

CAPSO Submits Comments to Treasury Regarding the Federal Scholarship Tax Credit (FSTC)


The Federal Scholarship Tax Credit (FSTC)—formerly referred to as the Educational Choice for Children Act (ECCA)—is a federal initiative designed to incentivize private contributions to scholarship-granting organizations that expand educational choice for families.


The California Association of Private School Organizations (CAPSO) has been supportive of this initiative in alignment with the Council for American Private Education (CAPE), of which CAPSO is a state network affiliate.


Consistent with this position, CAPSO submitted comments during the public comment period requested by Treasury, aligning its submission with the recommendations advanced by CAPE.

SB 848 and the New Year Bring New Expectations for Private Schools


As CAPSO has outlined over the past several months, the passage of SB 848- a comprehensive piece of legislation focused on student safety in both public and private schools- will have multiple points of impact on private-school operations. While the implementation timeline varies across the bill’s provisions, several components take effect at the start of 2026. A summary of those provisions is provided below.


Private schools are encouraged to consult with their governing organizations, and with legal counsel as appropriate, to determine how best to interpret nuanced elements of the law, including the expanded categories of mandated reporters (such as the definition of “volunteer”) and the updated requirements related to reference-check policies and practices.

CAPSO will continue to monitor the implementation of SB 848 and will keep private schools, through their member organizations, informed about relevant developments and emerging points of impact.



Mandated Reporters & Training (effective 1/1/2026)

Recognize and designate as mandated reporters: (§14(a)(1)–(42)) 

  • Employees, volunteers*, and governing body members of private schools
  • Contractors whose duties require pupil contact or supervision
  • Clergy members and custodians of clergy records
  • Athletic coaches, administrators, and directors


Hiring & Reference Checks (effective 1/1/2026) 

Reference Checks: before hiring, inquire with all prior employers about any credible complaints, substantiated investigations, or discipline for egregious misconduct. (§12(b)(2)) 

Reference Checks: upon inquiry, disclose to inquiring educational institutions if a report of egregious misconduct was made to the Commission on Teacher Credentialing (CTC), and provide all relevant substantiating information within your possession. (§6(a)(3)) 

Do not enter into any agreement that prevents a mandated report of egregious misconduct to the CTC or other agencies. (§12(a)) 

☐ Do not expunge or agree to expunge credible complaints, substantiated investigations, or discipline for egregious misconduct from personnel files, except in cases where the employee prevailed in a hearing. (§12(b))

The Supreme Court Revisits School Vaccinations Law


The U.S. Supreme Court has directed the appeals court to reconsider a Second Circuit decision that allowed New York to enforce school vaccination mandates against Amish families without religious exemptions. This direction was given in alignment with Mahmoud v. Taylor, which affirmed parents’ rights to opt their children out of public school requirements that substantially interfere with religious beliefs. The case stems from New York’s 2019 repeal of its long-standing religious exemption for school vaccines and subsequent penalties imposed on Amish families. While the ruling does not resolve the case, it signals heightened constitutional scrutiny of state policies that burden parental rights and religious freedom and returns the matter to the Second Circuit for further review.

En Banc Review Requested in Woolard v. Thurmond


In December 2025, three Christian homeschooling families petitioned the Ninth Circuit Court of Appeals for an en banc review, challenging how California’s nonsectarian requirements are applied within publicly funded charter homeschool programs. The families contend that the state’s rules were discriminatory, as they rendered faith-based instructional materials ineligible for reimbursement, and that these restrictions infringe upon parental rights and the free exercise of religion.


The case was previously heard in September 2025 by a three-judge Ninth Circuit panel, which affirmed dismissal of the families’ claims and held that California may require charter-school independent-study programs to remain secular.


CAPSO will monitor this case closely, as a potential en banc review could have broad implications.

Apply to Become a Green Ribbon School!


Did you know that private schools that participate in the Green Ribbon School process have the opportunity to be recognized at both the State and national levels?


The Green Ribbon School process is an opportunity to showcase efforts and be recognized for progress towards sustainability across three pillars: 

  • Pillar I: Reduce environmental impact and costs;
  • Pillar II: Improve the health and wellness of schools, students, and staff; and
  • Pillar III: Provide effective environmental and sustainability education



Each June, the California Department of Education launches the California Green Ribbon Schools (CA-GRS) application process, inviting public and private schools, districts, and county offices of education to showcase their achievements in sustainability. Participating schools have the opportunity to demonstrate achievement and earn points in pillar categories recognized in one of four tiered levels:

  • Bronze Level (Entry Level Commitment): 55-64.9%
  • Silver Level (Mid Integration): 65-74.9%
  • Gold Level (Full Integration): 75% or better
  • Green Achiever: Exemplary Achievement with Full Integration - Green achievers are nominated for Federal recognition in the U.S. Department of Education Green Ribbon Program (ED-GRS). 


Schools don't need to wait to apply until they have met full integration. Schools that apply will be supported with mentorship and resources, and schools with a 55%+ will be recognized with Bronze achievement by the California Department of Education!

California Green Ribbon Schools Achievers and Applicants Network: The CA Green Ribbon School Achiever and Applicant Network meets quarterly and aims to unite past, current, and future CA Green Ribbon Schools applicants dedicated to promoting sustainable practices and programs within their school communities. The network gives participants the chance to network with each other to inspire and share best practices.

Green Ribbon School Toolkit and Resources

No Cost Private School PD Available


The California Department of Education receives funds through Title II, Part A, Equitable Services to provide no-cost professional development to private school educators.


The website, https://www.capspdnow.com, offers over 1000 no-cost courses available to schools and teachers in an on-demand format. Private school teachers and administrators can join the CaPSPD email distribution list to receive notifications about upcoming development opportunities by sending a blank email to join-private-school-professional-development@mlist.cde.ca.gov
