The California Association of Private School Organizations (CAPSO) is the voice of K-12 private education in California. Its primary mission is to preserve the independence of California’s private schools and to uphold parental choice in education. CAPSO, independently and in collaboration with other community and governmental institutions, is an advocate, catalyst, and creative leader for strengthening and advancing K-12 private education in California. CAPSO’s mission is based on the belief that a healthy, pluralistic society depends upon educational options, parental choice, and dialogue and collaboration between educational entities.

Private School Affidavit Deadline Approaching


From the California Department of Education: The filing of the Private School Affidavit (PSA) is an annual requirement of all private schools offering elementary and high school level instruction in California. Per California Education Code Section 33190, an affidavit shall be filed with the California Department of Education (CDE) between October 1 and 15 of each year.


Filing the PSA is critical for private schools. Please make note of the quick-approaching deadline and use the link below to file.

Legislative Update: Tracked Priority Bills of 2023-2024


This legislative season CAPSO tracked and engaged with multiple bills that posed potential impact on private schools in California. Below please find the status of a few of the priority pieces of legislation. For a full list please visit the CAPSO Legislation Tracker.


AB 1864. Status- Signed by Governor

This bill requires reporting of specified types of information on applications for permits for the use of restricted materials, notices of intent (NOIs), and pesticide use reporting (PUR) forms; requires the Department of Pesticide Regulation (DPR) to adopt changes to the Pesticide Use Near Schools regulations, to expand their application to private schools.


SB 483. Status- Signed by Governor

This bill prohibits the use of prone restraint by local educational agencies (LEAs), nonpublic schools and agencies (NPS/A), and the State Special Schools for the Blind and the Deaf. Assembly Amendments: (1) eliminate the authorization for the use of prone restraint by trained personnel, thereby fully prohibiting educational providers at LEAs, NPS/As, and the State Special Schools for the Blind and Deaf from using, authorizing, or paying for prone restraint or similar interventions; (2) expand the definition of prone restraint to include any behavioral restraint that places a student facedown, including prone containment; and (3) name the act “Max Benson's Law” and make conforming changes to align with these provisions.


AB 3262. Status- Signed by Governor

This bill requires that when an automated external defibrillator (AED) is placed in a public or private school serving grades 6-12, the principal notify pupils, in addition to school staff, of the location of all AED units on the campus at least annually.


SB 1378. Status- Dead

Would, commencing July 1, 2025, require a public school, including a charter school, or a private school, as applicable, that serves pupils in any of grades 7 to 12, inclusive, that issues pupil identification cards to additionally have printed on the identification cards the telephone number for the Title IX Coordinator for the public school or, for a private school, the appropriate contact, and would authorize those public and private schools to have printed on the identification cards certain other telephone numbers of resources for Title IX assistance.

Parent Attitudes Shift Regarding School Attendance


The significant decline in school attendance has been linked to shifting parental attitudes towards education, particularly in the wake of the pandemic. Many parents are now adopting a more lenient approach to their children's attendance, often prioritizing flexibility over the traditional value of consistent classroom presence. This trend has contributed to rising absenteeism rates, which educators fear could hinder student engagement and academic performance in the long term. In response, schools are actively seeking to reestablish the importance of regular attendance and foster stronger connections with families, emphasizing the critical role that consistent participation plays in student success.

Nebraska Ballot: Private Schools Ineligible for Vouchers?


A proposed ballot measure in Nebraska that would prevent private schools from participating in the state's school voucher program. Advocates for the measure argue that it aims to protect public education funding and ensure that taxpayer dollars are allocated to public schools. Conversely, opponents contend that the measure could limit educational choices for families seeking alternatives to public schooling. As the debate unfolds, the implications for both public and private education systems in Nebraska remain a significant point of discussion among policymakers and stakeholders.

IDEA and Preschool Eligibility


The California Department of Education (CDE) has recently updated its guidance concerning equitable services and proportionate share funding for parentally-placed private school students with disabilities, specifically addressing preschoolers. This new directive reverses previous guidance by confirming that the equitable services provisions of the Individuals with Disabilities Education Improvement Act (IDEA) apply to children ages three to five enrolled in private schools offering transitional kindergarten or higher. The CDE now interprets the IDEA's definition of "elementary school" to include private institutions providing preschool and elementary education, thereby entitling qualifying students to individualized service plans. However, the CDE clarified that these provisions do not extend to "stand-alone" private preschools, highlighting potential inconsistencies in service access for similarly situated students. Local educational agencies are advised to review the classifications of private schools in their jurisdictions to ensure compliance and equity in service provision.

11th Circuit Court Ruling on Pre-Game Prayer


In a recent ruling, the 11th Circuit Court determined that the Florida High School Athletic Association did not violate the First Amendment rights of Cambridge Christian School when it prohibited the school from broadcasting a prayer over the stadium’s public address system before a 2015 championship football game. The school had claimed that this decision infringed upon its free speech and free exercise rights under both the U.S. and Florida Constitutions. This ruling may have broader implications for how schools navigate similar issues of religious expression in educational and athletic contexts.

The California Department of Education receives funds through Title II, Part A Equitable Services to provide no-cost professional development to private school educators.


The website, https://www.capspdnow.com, offers over 1000 no-cost courses available to schools and teachers in an on-demand format. Private school teachers and administrators can join the CaPSPD email distribution list to receive notifications about upcoming development opportunities by sending a blank email to join-private-school-professional-development@mlist.cde.ca.gov

WHAT: Write a letter of appreciation to District 12 Assembly Member Damon Connolly


WHY: It is imperative as private schools that we remain present in the minds of our legislators. Assembly Member Damon Connolly introduced AB 1864, legislation aimed at extending the pesticide exposure protections currently available to public schools in California to private schools. CAPSO commends Connolly for his efforts to include private institutions in this important protective measure. The bill has been signed by the Governor, and private schools can expect these legal protections to take effect in January 2025.
