Since our founding in 1966, CATIC has been built around a simple idea: the real estate closing process works best when attorneys and independent title agents remain at the center of the transaction. For six decades we have remained committed to that model, partnering with you instead of competing against you, and advocating for policies and legislation that preserve the role of attorneys and title agents in protecting property rights.

 

Your success has always guided our priorities. Over the years we have continued investing in tools, education, underwriting support, and operational improvements designed to help agents grow their practices and navigate an increasingly complex real estate environment. In the past decade, CATIC has expanded into new markets across the country and strengthened our commercial capabilities, supporting complex real estate transactions nationwide. Our regionalized commercial underwriting team now works with agents across multiple markets to handle increasingly sophisticated deals while maintaining the underwriting discipline that protects policyholders.

FinCEN Issues Guidance on the Real Estate Reporting Rule

March 23, 2026

 

The U.S. District Court for the Eastern District of Texas issued a ruling in Flowers Title Company v. Bessent declared the Financial Crimes Enforcement Network’s (FinCEN) new residential reporting rule (the “Rule”) unlawful and ordered it to be vacated. See CATIC’s Agent Alert here.

 

FinCEN subsequently responded to the decision by issuing the following guidance:

 

“In light of a federal court decision, reporting persons are not currently required to file real estate reports with FinCEN and are not subject to liability if they fail to do so while the order remains in force.”

 

While Reporting Persons are not required to comply with reporting obligations at this time, ongoing legal uncertainty means the Rule could be reinstated in the future. Based on the wording of FinCEN’s statement, agents may wish to continue collecting and retaining information required under the Rule, so they are prepared in the unlikely event reporting obligations resume retroactively. Please note, the earliest a report could be due under the Rule is April 30th, and we anticipate greater clarity regarding the Rule’s status at that time.
