CBP Plans CAPE Reconciliation Entry Processing for IEEPA Refunds by June 29
Customs and Border Protection (CBP) told the U.S. Court of International Trade (CIT) today, June 9, that it has turned its attention to expanding functionality for entries that are flagged for reconciliation to receive IEEPA tariff refunds. This capability should be available on June 29.
Since the launch of Consolidated Administrative and Processing of Entries (CAPE) Phase 1, CBP told CIT that more than 16 million entries have been processed, and more than $89 billion in both potential and certified refunds of IEEPA duties have been accepted for processing. So far, according to CBP, approximately $22 billion in refunds have been completed and sent to the Treasury Department for disbursement.
Once the reconciliation functionality is deployed, CBP will expand CAPE functionality to cover additional categories of entries, including entries filed by plaintiffs to actions in this Court and for which reliquidation is needed.
However, the Department of Justice (DOJ) has requested the court not to lift the suspension of immediate compliance. “Alternatively, it should stay the injunction pending appeal. If the Court lifts the suspension, it should administratively stay its injunction for seven days to permit orderly proceedings in the Federal Circuit,” the DOJ said.
Meanwhile, the NCBFAA Customs Committee and Counsel of Sandler, Travis & Rosenberg, P.A., will continue to monitor this situation with CAPE and provide further updates from CBP to our customs broker members as soon as available.
