Informed Consent in the Medical Office Practice Setting

Informed consent is more than a signed form. It is an ongoing communication process through which a patient receives understandable information about a proposed examination, treatment, procedure, or course of care; considers the available choices; asks questions; and voluntarily decides whether to proceed. In the medical office setting, a reliable, informed consent process supports patient autonomy, strengthens the clinician–patient relationship, and reduces misunderstandings about expected outcomes and risks.

What Makes Consent "Informed"?

Valid informed consent generally requires several connected elements: the patient has decision-making capacity; the clinician provides material information in language the patient can understand; the patient has an opportunity to consider the information and ask questions; the decision is voluntary; and the patient communicates agreement or refusal. The depth of the discussion should be proportionate to the significance, complexity, and risk of the proposed care.

Documenting Informed Consent

Documentation should show that a meaningful discussion occurred. Depending on the proposed care and applicable requirements, the medical record should identify the condition or reason for treatment; the proposed intervention; material benefits and risks; reasonable alternatives; the consequences of no treatment; the patient’s questions; any language or communication assistance used; the patient’s decision; and the name of the clinician who conducted the discussion. When relevant, the record should also note the date of consent, the identity and authority of any representative, and any change in or withdrawal of consent. A signed consent form may be required for certain procedures, but the form supplements rather than replaces the discussion.
