CELEBRATING A WIN
We don't usually self promote, but we have a nice success story we'd like to share because it illustrates the right way to work with Ignite.
The Lawsuit is Served
A client immediately sent over a lawsuit upon service. We took one look and knew it was serious business. It was filed in Federal Court and involved claims of violating the Fair Credit Reporting Act ("FCRA"). Both our client and one of the credit reporting agencies ("CRA") were named as defendants.
These cases can be difficult to resolve and very expensive to defend. After studying the complaint, we found the Plaintiff made claims and assumptions that seemed incorrect based on our knowledge of our client's process and the attention to detail paid by its personnel. In our view, it was likely that the CRA made an error and our client was included only out of the attorney's abundance of caution.
Ignite's Due Diligence
We dug into the facts, and they supported our findings. Next, we learned that the plaintiff's law firm frequently litigated these cases and had a substantial track record of success. To many, that would be discouraging. To Steve Levine, who has a background in litigation and trial experience, this represented an opportunity. Knowing that our findings supported our client and that they could muddy the waters in an otherwise compelling case against the CRA and cause delays, Steve reached out to the Plaintiff's lawyer and made a proposal.
Immediate Dismissal
After a few back and forth exchanges, the Plaintiff's attorney agreed to dismiss the case immediately. No expenses were incurred filing an answer. No retainer needed to be paid.
Successes like this don't come around every day, but when they do it is a great reason to puff out one's chest and enjoy the victory.
