OAL Approves the Advanced Clean Trucks Regulation - Large Entity One-Time Reporting Due April 1, 2021

The Office of Administrative Law (OAL) has approved the Advanced Clean Trucks regulation. Large entities operating or dispatching vehicles with a manufacturer’s gross vehicle weight rating (GVWR) greater than 8,500 lbs. (such as trucks, buses, and vans) must report by April 1, 2021, if they meet any of the criteria below.

Who must report
Large entities (fleet owners, businesses, government agencies, municipalities, brokers, etc.) will report information about their vehicles over 8,500 lbs. GVWR (hereafter referred to as “vehicle”) if in 2019 they operated a facility in California and meet any of the following criteria:
  • Had gross annual revenues greater than $50 million in the U.S. for the 2019 tax year, including revenues from all subsidiaries, subdivisions, or branches, and had one or more vehicles under common ownership or control that were operated in California in 2019; or
  • Any fleet owner in the 2019 calendar year that had 50 or more vehicles under common ownership or control; or
  • Any broker or entity that dispatched 50 or more vehicles into or throughout California, in the 2019 calendar year; or
  • Any California government agency including all state and local municipalities that had one or more vehicles that were operated in California in 2019; or
  • Any federal government agency that had one or more vehicles that were operated in California in 2019.

Reporting is not required for K-12 school bus fleets, transit vehicles, military tactical vehicles, vehicles awaiting sale, nor emergency vehicles as defined in section 2012(c) of the regulation.

What information needs to be reported
Affected entities will need to report general entity information, home-base locations, and information about their vehicles (including off-road yard trucks) and how the vehicles are operated. Vehicle operation includes information about vehicle body types, daily miles traveled, where they are fueled, and other usage characteristics.

CFCA Memorial Scholarship Fund Applications Open Next Month

Originally established with contributions made by industry friends in memory of Ron Ahlport, Fred Bertetta Sr., and Jim Divine, the CIOMA Memorial Scholarship Fund provides financial assistance to help children and employees of CFCA members further their education and professional development.

Applications for the Memorial Scholarship Fund open next month, so please be sure to spread the word to employees, coworkers, and colleagues!

Last year, CFCA was treated to something special, when CMSF winner, Theresa Thompson shared with us the work she is doing with the Duke University Engineering COVID Response Team. Theresa and her team developed a special system for hospitals to use on COVID patients to reduce the spread of the virus and protect medical staff. CFCA is incredibly proud to help support Theresa and students like her in pursuing their dreams.

NACS Day on the Hill Coming Up Next Week!

Next week, CFCA and members will be participating in NACS' Day on the Hill. This year, like many other events, this will be held virtually to accommodate for COVID-19.

However, just because this event will be held virtually, does not mean it will be any less successful. NACS' government relations team has been hard at work setting up meetings with crucial members of Congress, to discuss everything from credit card swipe fees to EV charging.

CFCA will report back on the event as soon as it has concluded.

Facing a historic recall effort backed by the national GOP heavyweights, Gov. Gavin Newsom has drafted a muscular squad of seasoned Democratic operatives to defend his job.

Newsom's team is dominated by veterans who have guided his career and have directed the campaigns of other Democratic stars, including Vice President Kamala Harris, U.S. Sen. Alex Padilla, Attorney General Xavier Becerra and former Gov. Jerry Brown.

As Newsom Recall Hits Milestone, Democrats Scramble for United Front to Keep Governor in Office

With backers of the recall against Gavin Newsom formally submitting the last of their petitions Wednesday, Democrats from California to Washington were readying what they hope will be a united front to keep the embattled governor in office.

Newsom's campaign is trying to keep the party focused on fighting the recall and preventing prominent Democrats from getting into the race to replace him if it qualifies for the ballot as expected. He has racked up high-profile endorsements from Sens. Bernie Sanders (I-Vt.) and Elizabeth Warren (D-Mass.), among others, and hopes to tie the recall campaign to former President Trump and extremist groups.

The governor went on a national media tour this week, speaking out against the recall and generating both cheers from supporters and some controversy.

As State Reopens, Californians Remain Cautious

A new poll released by Nexstar Media Group’s six California Television Stations along with Emerson College found that while the state begins to relax restrictions and reopen amid the coronavirus pandemic, Californians remain cautious of resuming most activities.

The exclusive new statewide poll of more than 1,000 registered voters, which has a margin of error of +/- 3%, shows right now COVID-19 remains the top issue and Californians are hesitant to resume a pre-pandemic lifestyle with nearly half the respondents not ready to eat indoors at a restaurant.

California Considers Relaxing Rules About Ballot Signatures
March 15, 2021

California’s Democratic-controlled Legislature is considering whether to make it more difficult for local election officials to reject ballots because a voter’s signature doesn’t exactly match what’s on file.

Voters who cast ballots by mail must now sign their ballot. Election officials then compare that signature to the one in the voter’s registration file. Election officials can disqualify ballots if the signatures don’t match.
