2024 EEO-1 REPORTING PORTAL NOW OPEN & DEADLINE APPROACHING

The U.S. Equal Employment Opportunity Commission (EEOC) has officially opened the 2024 EEO-1 Component 1 reporting portal. Employers subject to EEO-1 reporting obligations must submit the required employee demographic data by June 24, 2025, at 11:00 PM Eastern Time.

What Is the EEO-1 Reporting Portal?

The EEO-1 reporting portal is an online system where employers submit their annual data collection, also known as the EEO-1 Component 1 Report. This report requires eligible employers to provide workforce demographic data, including job category, sex, and race or ethnicity of employees.

Who Must File the EEO-1 Component 1 Report?

Private employers with 100 or more employees, and federal contractors with 50 or more employees must submit EEO-1 data. Employers must select a payroll end date between October 1 and December 31, 2024, to serve as their "workforce snapshot period" for the EEO-1 report. All employees on the payroll as of that chosen date must be included in the report. Importantly, even if an employer has fewer than 100 employees on the selected date, it is still required to file if it had 100 or more employees at any point during the fourth quarter of 2024.

When is the Deadline to Submit?

This year’s turnaround time is quite short. Employers must submit their data by June 24, 2025, at 11:00 PM Eastern Time.

What Is New This Year?

Non-binary options for reporting sex are no longer available in the EEO-1 reporting form. Thus, employers should not report non-binary employees for 2024.

What Should Employers Do?

Given the fast-approaching deadline, employers should take immediate steps to (i) determine whether they are required to submit the EEO-1 Component 1 Report, (ii) select a "workforce snapshot period" date for 2024, (iii) categorize employees in the appropriate EEOC job categories, (iv) allow employees to voluntarily self-identify their race/sex/ethnicity, and (v) submit the completed report by June 24.

Has the EEOC Provided any Guidance?

Yes, the EEO-1 instruction booklet is now available here. Also, the EEOC has a Filer Support Team, which can be contacted here.
