Judge Melody Stewart '88  and  Judge Michael Donnelly '92  were elected to the Ohio Supreme Court in the November election. They join current  Chief Justice Maureen O'Connor '80  on the Court.  

With three judges, Cleveland-Marshall has the most judges on the Ohio Supreme Court of any law school.   Justice-elect Stewart is the first African-American woman to be elected to the Ohio Supreme Court.

Judges Stewart and Donnelly replace two other Cleveland-Marshall graduates on the Court Justices Terrence O'Donnell '71 and William O'Neill '80.  They join a long list of  Cleveland-Marshall graduates to serve on the Ohio Supreme Court, including, but not limited to, Justice Leonard Stern '26, Chief Justice Frank Celebrezze, Jr. '56, Justice Francis Sweeney, Sr. '63, and Justice James Celebrezze '67.

In Adjunct Professor David E. Schweighoefer's Psychiatry and the Law class, students learn about situations regarding mentally ill patients, what happens to get to the point where a person needs a civil commitment and how the process for establishing the civil commitment takes place. Three Cleveland-Marshall students now have the opportunity to put their knowledge from the class to real-world use as they work on an independent study with Schweighoefer and St. Vincent Charity Medical Center with hopes to amend the Ohio Revised Code.

Prof. Sundahl Appointed as Advisor to NASA 

Professor Mark Sundahl was appointed to the  NASA Advisory Council Regulatory and Policy Committee. The Committee will provide advice regarding the policy and regulatory changes that are needed to assist NASA in its mission to increase hu mankind's understanding and use of outer space.

Professor John Plecnik was awarded a bilateral grant from the Public Research Agency of the Republic of Slovenia.  The grant will support an international faculty and research exchange between Cleveland State University and the Graduate School of Government and European Studies to discuss "the rule of law in the constitutional systems of Slovenia and the United States of America."

Professor Chris Sagers published " Antitrust Law as a Problem in Economics" in the Oxford Research Encyclopedia of Economics and Finance. The Encyclopedias are a series of free online resources of the Oxford University Press, featuring contributions by leading experts and used by researchers around the world.

Professor Doron Kalir published a position paper on Scholars Strategy Network, "The Need for Principled Balancing When Constitutional Values Collide." The paper examines the aftermath of Masterpiece Cakeshop, where the Supreme Court did not resolve the tension between two constitutional values - religious freedom and equality.

Professor and Associate Dean Milena Sterio  published a post on Intlawgrrls, "International Law on Statehood and Recognition: Israeli-Palestinian Conflict and the South Caucasus."

   
Professor and Associate Dean Milena Sterio presented at a conference, "The Centennial of the Independence of the Three South Caucasus States: Historical Background, Contemporary Developments and Prospects of Peace and Prosperity" in Ankara, Turkey. The conference was organized by the Center for Eurasian Studies as well as the Embassy of the Republic of Azerbaijan to the Republic of Turkey. Sterio's remarks focused on "Statehood, Recognition, and Prospects for Peace in the Caucasus."

Debt Collection, Bankruptcy & the Ohio Receivership Law

The three hour seminar aims to educate attendees on debt collection, bankruptcy and the Ohio Receivership Law.
 
Judge Patrick Carroll will present on Default Judgements. This presentation includes the procedural steps to obtaining and maintaining a default judgment by a plaintiff.  The seminar includes the application of Civil Rule 55 in civil actions.  This also includes issues of personal and subject matter jurisdiction, capacity of defendant, appearance by defendant, time limitations, military affidavits, and calculation of damages, including limitation and hearing on damages.  Civ. R.8(D). Including post judgment motions, issues of relief from judgment by Civil Rule 60 and void and voidable judgments as well as collection/enforcement of judgment.  Other issues include default judgment and/or dismissals as sanctions for noncompliance with discovery or other court orders.  Other related civil procedural issues include comparison with judgment on the pleadings, summary judgment, ex parte trials, leave to plead, and attachment top leadings.  

Colette Gibbons and  Scott Opincar will review recent amendments to Ohio's receivership law and discuss significant appellate cases decided under those amendments. 

Julie Rabin  will be speaking on Chapter 7 and Chapter 13, the two bankruptcy options used most widely by individuals seeking relief from financial distress.

This three hour video replay on professional responsibility is a well-regarded seminar focused on providing Ohio's lawyers and judges with timely information regarding ethics and professionalism. 

The Oh *!?#@ I Got a Grievance presentation will cover procedures for filing and resolving grievances, including when and why to use the disciplinary process, along with a brief understanding of the investigation process. 

The Unauthorized Practice of Law: A Trap for the Unwary segment covers unauthorized practices of law including admissions, non-lawyers collecting payment, etc. 
 
Switching Law Firms: Walking the Tight Rope will be led with a discussion about lawyers switching law firms and the parameters that surround the issues that arise from both sides - the law firm perspective and the lawyer perspective, along with a variety of topics, including the big "what-ifs," how and when you should reach out to clients, origination + fees, etc. 

Lastly, the Ethical Pitfalls in the Transactional Practice segment will discuss ethics through the transactional lens, and go over practical issues for transactional lawyers, including ethical pitfalls, such as candor to third parties, attorney-client privilege in deal documents, amongst others.
