Request for Comments - Annual E-Filing (NYSCEF) Report

The New York State Office of Court Administration (OCA) will be submitting its annual electronic filing report, to the Legislature, the Governor, and the Chief Judge evaluating the State's experience with the New York State Courts Electronic Filing System (NYSCEF). In past years, OCA's Division of E-Filing has invited comments on electronic filing and the NYSCEF system. Once again, they are seeking input for inclusion in this year's report.


This year marked several major expansions including:


  • Supreme Court - Civil Term: Mandatory e-filing is now in effect for all case types - including those previously exempt - in 61 of the 62 Supreme Courts statewide. Allegany County remains the only Supreme court without an e-filing program, while Erie County successfully expanded to mandatory e-filing for all case types as of January 1, 2026.


  • Family Court: E-filing has expanded to 24 counties.


  • NYC Civil Court: Mandatory e-filing now applies to consumer credit matters.


  • Criminal Pilot: As a major milestone, the first criminal e-filing pilot was launched in Kings County Supreme Court, Criminal Term.


Unrepresented persons continue to be exempt from e-filing unless they choose to

participate. Attorneys may still opt out of e-filing if they lack the equipment or technical knowledge to e-file. Finally, these expansions do not alter existing confidentiality requirements for actions where such protections apply.
