Credit Card Surcharge Guidance

Starting February 11, 2024, there is new guidance for New York State businesses when charging an additional fee to customers paying with a credit card. (NYS GBS §518). Businesses are prohibited from advertising a price and adding a surcharge at the point of sale when a consumer chooses to pay with a credit card. Instead, businesses must inform consumers of the higher price for a product or service when paid with a credit card by displaying the higher price. However, businesses can offer a discount to customers who pay in cash.
