Olmstead Planning Survey Open

Good Morning Olmstead Plan Stakeholder Advisory(OPSA), Olmstead Community and the OPSA Staff Work Group,

In order to obtain input from stakeholders who were not able to participate in an Olmstead Planning Listening Session, the Technical Assistance Collaborative (TAC) has adapted the Listening Session polling questions into a survey. The survey asks about strengths, gaps, challenges, and ideas stakeholders have regarding services and supports for North Carolinians with disabilities, including children, youth, adults, and older adults. The results of the survey will help to inform TAC's analysis of the states' resources/services and the recommendations for the states' Olmstead Plan. Survey responses will be anonymous and data will be collected by TAC (via TAC's Survey Monkey account). The survey will be open for responses between September 8 and 22, 2020.

CMS, ACL Publish Joint Discharge Planning Tool:
Maintaining Services for Adults with Disabilities Who Live in Community Settings
Last week, the Centers for Medicare and Medicaid Services and the Administration for Community Living published the Discharge Planning a Care Coordination during the COVID-19 Pandemic tool. This tool is targeted towards nurses, social workers, case managers, and others conducting discharge planning for adults with disabilities.

It explains the Olmstead decision, lays out potential pathways for adults with disabilities diagnosed with COVID, explains the CMIST framework and person-centered planning, provides considerations for three potential discharge scenarios to facilitate person-centered discharge planning and care coordination to the most integrated setting, and provides state and federal resources to assist the care coordinators and discharge planners.

Back to School and Paid Leave

The U.S. Department of Labor (DOL) issued updated guidance with answers to questions about how the paid leave requirements under the Families First Coronavirus Response Act (FFCRA) applies to parents whose children are engaged in remote learning this fall ( see questions 98-100 in the DOL guidance).

In schools operating on a hybrid system alternating days or weeks of in-person and remote learning, parents are eligible for FFCRA leave on days when their children are engaged in remote learning, since schools are deemed "closed" on those days. The guidance provides that parents are not eligible for FFCRA leave if they choose a remote learning option for their children when schools are offering the option of hybrid or in-person learning since schools are not "closed."

The guidance suggests, however, that these parents may be eligible for FMLA on the days when their children would otherwise be learning remotely in a hybrid system. Finally, in school systems that are temporarily using only remote learning but may switch to a hybrid or in-person system later in the school year, parents are eligible for FFCRA leave during the period when all learning is taking place remotely.

The FFCRA mandates paid leave for most employees in nonprofits under 500 employees, with some exceptions, when their children's school is closed or when childcare is unavailable due to COVID-19 and that employee is unable to telework.

See analysis of the FFCRA.

COVID Response
The regular weekly podcast is out with a terrific one-on-one debate on the scientific community's reaction to COVID-19. Are sweeping public health controls the best way to fight a second wave of infections? Or does the data show we are dramatically overestimating the virus' lethality and we need to recalibrate our response?
