Dear Restaurant and Banquet facility Owners/Operators, 
 

INSTRUCTION PURSUANT SCHEDULE 1, SUBSECTION 2(2) OF ONTARIO REGULATION 364/20 – RULES FOR AREAS IN STAGES 3 - OF THE REOPENING ONTARIO (A FLEXIBLE RESPONSE TO COVID-19) ACT, 2020 

Whereas the Province of Ontario has enacted the Reopening Ontario (A Flexible Response to Covid-19) Act, 2020 and Regulation 364/20; And whereas the said Regulation requires that each person responsible for a business or organization that is open to operate the business or organization in compliance with the advice, recommendations and instructions of public health officials, including any advice, recommendations or instructions on physical distancing, cleaning or disinfecting; And whereas Dr. Hsiu-Li Wang, Associate Medical Officer of Health, Region of Waterloo Public Health, provides the following instructions: 

1. (1) Each person responsible for a restaurant, bar or other food or drink establishment in The Regional Municipality of Waterloo shall record the name and contact information of every patron that enters an area of the establishment unless: 

a) the patrons temporarily enter the area to place, pick up or pay for a takeout order; or 
b) the establishment is a limited-service establishment, in which case the requirement to collect the name and contact information of at least one member of every party of patrons shall apply. 

An establishment is a limited-service establishment if it requires all dine-in patrons to order or select their food or drink at a counter, food bar or cafeteria line and pay before receiving their order. 

(2) Each person responsible for a restaurant, bar or other food or drink establishment in The Regional Municipality of Waterloo shall maintain the records pursuant to subsection (1) of this section for a period of at least one month and shall only disclose the records to Region of Waterloo Public Health under the Health Protection and Promotion Act on request for a purpose specified in section 2 of that Act or as otherwise required by law. 


2. Each person responsible for a restaurant, bar or other food or drink establishment in The Regional Municipality of Waterloo shall ensure that background music and any other background sounds, such as from televisions or other electronic sound producing devices, is no louder than the volume of normal conversation.
