Below please find the twenty-first edition of Stearns Weaver Miller's COVID-19 Legal Compass, highlighting government updates, alerts on critical topics, and resources to help you navigate and adapt to this rapidly changing environment.  

All actions described below have been ordered or updated between September 14-25, 2020. We have done our best to include significant, timely information, although new orders and actions are being introduced continuously. View a comprehensive listing of the government actions pertaining to COVID-19 that we have collected to date.

As the release of mandates by local governments tend to be slowing down, our team will no longer be updating the local government portion of the Legal Compass.

RECENT STATE OF FLORIDA GOVERNMENT ACTIONS
  • State of Florida Moves Into Phase 3: Governor DeSantis took action moving the State of Florida into Phase 3 of the Governor's "Safe. Smart. Step-by-Step. Plan for Florida's Recovery."  This Executive Order is effective immediately and has been extended through November 3, 2020. The Executive Order does the following: 
    • Removes state-level restrictions on businesses, such as restaurants.
    • Provides that no COVID-19 emergency ordinance may prevent an individual from working or operating a business.
    • Provides that restaurants may not be limited by a COVID-19 emergency order by any local government to less than 50% of their indoor capacity. If a restaurant is limited to less than 100% of its indoor capacity, such COVID-19 emergency order must satisfy the following:
      • Quantify the economic impact of each limitation or requirements on those restaurants; and
      • Explain why each limitation or requirement is necessary for public health.
    • Suspends the collection of fines and penalties associated with COVID-19 enforced upon individuals.  

    Executive Order 20-244 does not rescind the underlying COVID-19 State of Emergency Executive Order (20-52) that gives the Governor emergency authority related to COVID-19 pandemic. Click for more.
